PLEASE read my original post (attached here!!)!! If the rifle was manufactured with a fixed box magazine (non-removable), and you do not remove it and install a removable magazine, you are not illegal.

The way the law is written is how it is written. How some accept certain things in contrary to the law is an entirely different matter. Just like open carry while hunting. Both laws were written by ignorant politicians with no understand on firearms. They inadvertently wrote these laws not knowing they were banning something and law enforcement and ourselves try to use common sense with them. We do what we need to do and they look the other way.

Now this I have to disagree with. i do not believe there was anything 'inadvertent' about it. They merely got caught grasping for too much, too soon.
They knew EXACTLY what they were doing, and what they hoped to achieve.
Remember, for most of these left-leaning politicians, the police are as evil as we Law-abiding firearm owners are, if not more so.

An SKS that has an integral box magazine has to be disassembled to remove the integral magazine, and install the removable magazine. I don't see how an SKS with the integral box magazine can get misinterpreted as an "assault weapon"! I understand it can happen, I understand the law is total bullshit, BUT...

SKS's are legal in NY , they sell em in the store. WTF? if it was modified then it would fall under the ban otherwise they are legal.

Just because they sell something in the store because it's always been sold doesn't mean it remained legal after they changed the law and inadvertantly made it illegal. FFL's aren't appeals court judges. I mean there is an FFL on this forum who sells mag catch devices that don't make your rifle legal but it's sold anyway due to his interpretation. Other FFL's have sold standard rifles with bullet buttons too until they were told not to after someone got caught with one.
The same goes with open carry as I've mentioned numerous times already. Your license doesn't give you that exemption to open carry yet how else are you going to hunt? It's ignored just like the SKS is ignored at the moment until someone commits a heinous crime with one in this state and someone really looks at the law and says that it is capable of accepting a detachable magazine.
Some FFL's have even sold 30 round magazines with just a block of wood or plastic in them in the past. Some FFL's won't even sell a Thordsen AR or an SKS. Ask me how I know. I was told "No can do." by one in my area because it had a bayonet. I had to go elsewhere. The same thing happened with my Keltec KSG.
FFL's don't know shit unless they can comprehend English and actually spend time reading and understanding the laws like some members here do. And the ones who do sell questionable stuff will continue doing so until the unlikely event when a law abiding citizen commits a crime with one and the prosecutor looks at things with a microscope.

Interesting take on the legality of the SKS Will. However as you state it can accept a detachable mag the rifle does require some modifications to do so. Also as you read the letter of the law, even with a detachable mag it still wouldn't be an "assault weapon" by the NY SAFE definitions because it has no other evil features. By the letter of the law I'm not sure that having a bayonet is illegal. Law states a bayonet lug however on most SKS the bayonet is attached on a swivel and clicks in over the end of the muzzle. If the 'swivel' is removed the rifle is totally good to go as featureless with or without the mag upgrade. M1 Garand, M1 Carbine, M1A, Ruger Mini all good. Side note is that the SKS is more reliable without messing with the attached mag according to internet gurus.

Correct. In it's standard form with no features with a standard stock it can never be an AW. I missed that because I used to have a Tapco stock and a bullpup stock.
