That's called being a defeatist.

By what you guys stated, Jim shouldn't even be trying. That's how you stay oppressed.

I've always viewed a defeatist as someone who wouldn't bother fighting. I'm in no way saying that Jim is wasting his time or shouldn't bother with this case. It's definitely not enough to only fight the fights you think you can win, you need to fight the fights that need fighting. But it's not defeatist to have a realistic viewpoint of your chances of victory.
