Unrestricted Amendment Advice.

In regards to PP offices, patience always seems to be the best course of action.

Does Madison Cty require a face to face with the issuing judge to amend to unrestricted? In Orange Cty I had to meet with the judge before he'd sign off on unrestricted. FYI, I already had my NY license for 30 years at that time.

Face to face because a judge can tell by looking at you.
8 HR course because that will make you an expert.

I would wait, see what SCOTUS comes up with this summer. You may have it then.

Of course i can NY making everyone apply and charge us a fee to get our Constitutional right reinstated

They're legally required to give you an answer in 6 months.

If you push the issue, the answer will be "no".

I'd let it wait. If youve done your reading here, you'll know that you're lucky to be in Madison County. I see others wait months for amendments while I can buy pistols and pick up in less than one hours time. I had my restrictions removed years ago and i didnt even ask for it! The kind lady at the sheriffs office just said she would take care of it.

I’d wait a bit. The holidays were in there, but everyone seems afraid of the PPO, but I had to contact them in my county a few times and they were nothing but wonderful. I moved in the middle so I had to update my address, it was unplanned and it took over a year for my permit. Also the fingerprint place screwed up my name and it wasn’t in the format they wanted so I emailed them, they said not a problem and they would take care of it. I also contacted them once for an update since after everything was submitted it took the judge 8 months to sign it. They were polite then too.

I believe the way is written, once the Judge receives the paperwork, he has 6 months to render an answer.

I think the law says, "issuing Authority". Not from the time the paperwork gets into the office.

Huh. All I had to do in Orange was write a letter to the judge and send it in with an amendment form. But similar to you, I'd had mine for over 30 years

As frustrating and time consuming as the process in Erie is, thank God they issue "unrestricted" on the initial license application.

My request was back in 2013, there or about.
My wife got her CC unrestricted out of the gate just last year. Also in Orange. No meeting with the issuing judge either.

I know that's how they want to interpret it, but any reasonable court would interpret it as 6 months from turning it into whoever you are supposed to turn it in to.

Imagine if a statute said you had 60 days to pay a debt after being notified, and I opened all the mail for my wife and just sit on her notifications till we felt like paying.

Now imagine a judges reaction when he found out she knew I routinely did that.

"issuing Authority" .. the judge is not issuing the paperwork you need to fill out ...... he/she just finalizing the privilege for you ..

That is what they claim, but who issues it really? If I remember it says the licensing authority, but neither here nor there. IMO I file with the county so they are the person issuing it not the judge, the judge just approves it or denies it. It’s kind of funny they had mine sitting in a pile waiting to go to the judge to avoid this. It sat for 8 months between PPO and judges desk.
I think they claim this just to avoid a lawsuit and it’s worked so far.

Well put. As stated below the judge had mine for 8 months, well not really because the PPO let it sit on their desk for a few months before sending it to him to avoid this very 6 month window. I agree with you’re assessment.

Exactly, The Judge does not just do pistol permits, they have trails, case law to review and other duties. So yes the applications sit in the PPO till he/she requests some be sent to him/her for final review. The Judge here in Saratoga County is known to take some of them home with him ( not a job requirement )

Just from skimming through here I would say it's fine to call and see what's up. I don't put much stock into the "horror stories" that float around sometimes. I've had nothing but good experiences with my local permit office. Why wait around all day like a jerk? Call them up. You're a member of the public and they are there to provide services to you. Just be nice and polite.

Went to the Madison County Sheriff's office yesterday so that my complete name will be on my permit instead of a middle intial. Nobody will sell you a gun without an id showing a full name. Cost me $20 and she also added the new "semi auto" to the back of the permit. You still need to make appointments to get in but Sue is alaways super quick. I left her a message at 7:45 and she called back with a 10:00 same day appointment.
