Use of deadly force laws?

A lot of this so called 'castle doctrine' depends on where you are and the District Attorney for that political entity, which can vary from, "I don't believe in that castle bullshit" to , "sounds like a good shoot to me".

I wouldn't want to test that in court if you could just drive off though.

Except, as shown in the illegal BLM/Antifa riots, "just driving off" is inherently a deadly force situation.
If someone is trying to carjack my Jeep and I drive off, there is a very good possibility they will be caught under the rear wheels. Or if they are in front of or behind my vehicle and that happens to be the only escape route.

NY has a castle doctrine. Duty to retreat is outside the home. Someone in your house doesn't even have to even be armed.

No duty to retreat while in your home however still need to have reasonable belief (and convince a jury) that the actor was in process or about to commit deadly physical force on you or another before using deadly physical force.

I would never shoot to prevent any of those reasons above. Call a cop..

And make sure you have popcorn while you sit there enjoying the show until said cop finally arrives.
I'm sure the family of the victim will be appreciative that no criminal was harmed in the process.

But I get it. People are dragged over the coals for being good samaritans. The powers-that-be have effectively created and enforced antipathy among the people. A reluctance to help as well as an aversion to even understanding others.

The days of "brother can you spare a dime" are long gone. Now people keep their heads down, their noses buried in their smartphones as a means to not have to interact with others in the real world.

If you possess a deadly weapon, you *can* use deadly force, for anything.

The question "may I" isn't the right one either. If deadly force is called for, then you'd better use it whether you have permission or not.

So, the proper question with use use of deadly force is "*must* I use deadly force". If you have a choice the answer is no.


If you are in a "I must" situation, and you are unable or unwilling to do so, then you may not be able to live with yourself (if you live at all).


Kinda like wearing a parachute on a plane. If you've got a choice, then you don't need it. But if you need it then you *really* need it.
