Home intruders got an unexpected surprise after breaking into an Asheboro home.

The suspects were met with a gun drawn once they exited the home. Stephen Routh watches over his parent’s home on McKnight street and after getting a call about some unusual people on the property he made his way to see what was going.

Once he arrived, he saw three suspects trying to leave out of the back door.

That’s when he held them at gunpoint and ordered them onto the ground while talking with 911 dispatchers.

“I had the gun and they were coming out, and as soon as they saw the big gun pointed at them, their hands went up," said Routh.

Cell phone video captured the intense moments.

Under the whole "duty to retreat" edict in New York Law.
He did not live at the premises. He was not IN the premises at the time he pointed a weapon at the perps. Per NYS Law that is brandishing and menacing. They could probably hang an "unlawful detainment" charge on him as well.

Prove me wrong. But that is the way New Yorkers are treated when trying to defend themselves, neighbors and loved ones, and property.

How many of you guys have been on here, and the previous forum, saying "don't shoot the perp outside the home" and "going outside to confront is wrong".

So you're saying it is actually OK to detain a suspect outside the home? That it is OK to leave your home, armed, and detain someone breaking into your neighbor's home?

That in a bit shell is NY's castle doctrine.

Are New Yorkers allowed to restrain somebody at force of death via firearm in a circumstance in which the person with the gun is not fearful of their own safety or a legal third party? I imagine as mentioned he could in fact be charged under unlawful imprisonment and brandishing, etc.

In other words is there anywhere in NY law that tolerates pointing a gun at another person unless involved in self-defense? I don't think so.

At this point, though, he had successfully terminated the burglary with his gun, so now he was using it to arrest people, not stop a burglary.

As an aside I wonder what would have happened if they had just said screw this I'm off, and run away. 100% he could not have shot them in that circumstance (in Texas he probably could have).
