This just an effort in the messaging that Trump is guilty of 18 U.S. Code § 2383 - Rebellion or insurrection when in fact that charge hasn't been filed against him or anyone for the supposed Jan 6th narrative. All person are assumed innocent until proven guilty in a court of law anyway.

SCOTUS actually doesn't have to decide and shouldn't as only a political narrative will be made of the decision. That is the intent though. SCOTUS should just remain silent and not take up the case. Just like they do with 2A cases.
