The person who commits a felony AND by doing so sets in motion a chain of events which leads directly to a death of another, is criminally liable for that death of another. In New York the shorthand term is 'felony murder' which is a confusing term, because then someone who is not familiar with the law invariable asks 'aren't all murders felonies?' And the answer is 'yes, that's just the term that is used.'
No, the original felony does NOT have to involve intending or causing death. It could be (and often is) a stolen car which kills someone.
In New York, Murder First looks more at the status of the victim of the crime as opposed to premeditation. LE, prison guards, witnesses, contract killings, or murder during a violent felony such as robbery.
