Would This Firearm Be Treated Like The Shockwave?

@Marine Cpl @BDinPutnam @Airborneguy I trust your judgements and you guys seem like you know the outcomes and the law pretty well. This is the aws spets-12 firearm. I read NY law on shotguns and it states "Shotgun" means a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder and designed or redesigned and made or remade to use the energy of the explosive in a fixed shotgun shell to fire through a smooth bore either a number of ball shot or a single projectile for each single pull of the trigger. Is this another “it’s legal but should’ve attempt.”? Or would it be another version of the shockwave? I would like to know your guys thoughts.

It’s neither a shotgun, pistol, nor rifle. I would say legal but there’s always what a cop says. There is more precedent with shotgun firearms than AR firearms so I would be more comfortable with this because we actually have a definition in NY law for what is a rifle and a shotgun.

Did you see these 2 models for sale in NY somewhere? I saw an lgs selling high points and I've always wanted one. But know they are not safe act compliant, so I asked if those were LE only and he said no, they are perfectly legal in his eyes, that a magwell and a pistol grip are 2 different things and since one is the same on a highpoint they negate the fact... sounded good but I passed on the carbine in .45acp and picked out the next best thing, a .410 shockwave... has a lil paper says legal in NY he gave me with it lol... let us know how it works.out they look sweet and I would mind having one my self...

And did he write up the paper that he gave you with the shockwave? Not saying it isnt legal but you best believe NY will never put out documentation on the shockwave being legal

He had a little stack of 3x5 cards that explained what the Shockwave was and why its ny compliant... said LEGAL IN NY in bold across the top with about 2 or 3 sentences. Perhaps he made them, or his distributor made them, they didnt look official but they did look professional in quality... i tried to find it to share a picture but I can't locate it, if I do find it ill post it.
As far as the HP, he had 3 different models, I simply didn't pursue it further after asking if they were LE only... could be a fing trap...
If the average person buys a firearm from a FFL that isn't compliant is it on the buyer or seller?

That’s just because they do not want to do business with us. But an FFL can buy one and resell it.

There’s a lot of NY compliant firearms that companies won’t even considering shipping to NY due to the confusing laws and complicated infringements.

NY law says that a firearm is a pistol, revolver, short barreled rifle or shotgun, or an assault weapon. Firearms are illegal in NY unless exempted.

This does not fall into any category in NY law as per their definitions. Technically it’s just like a screwdriver. No background check needed. It’s not a firearm according to NY law.

But, it’s a firearm according to the Feds. So a background check is needed for federal purposes just like one is needed for a regular rifle or shotgun that isn’t a firearm according to NY law.

As long as it doesn’t go against what the feds and ATF are saying, NY shouldn’t be allowed to make up their own terms and when people find loopholes they redefine those terms.

I suggest you go look up what I'm referring to, I think you will find it enlightening.

NY and ATF are referring to very different things.
