I'll agree with you on that. I think the problem is likely that there are not 5 who would vote in favor of it. I think Kennedy and Roberts are suspect. So, here's hoping that Kennedy retires soon, and Ginsburg cashes out soon as well. However, I doubt that Peruta will be kept on hold long enough for it to be of any use in restoring our rights.
