Duty to inform laws?

Has anyone had any experience with carrying a handgun while at a traffic stop? Does NY require me to tell the cops I am carrying and if so how do you handle the situation?
If a cop asks to see your weapon, do you clear it and hand it to them or ask them to remove it from your holster?

NY State does NOT require you to inform the Police that you are armed. If it comes up that you are, or if you are asked to turn over the gun, the cop will disarm you.

I've been driving for 16 years and have only been pulled over once. So it's not like this is something that I am worried about happening. Just looking for some knowledge

keep your hands where the cop can see them and wait for instructions. I carry small of the back on my wallet side so I will be telling the cop while my hands are on the steering wheel. I tried to remember to put my wallet in the cup holder, but I forget to do it and have forgot my wallet in the car then. So I've decided most likely I won't get pulled over and just don't worry.

Years ago when I first started carrying, I got pulled over for a broken brake light. I had my hands on the wheel and mentioned to the cop that I had a CCP and my firearm was on my person. He asked where and I nodded my head down and left (AIWB/Southpaw). I asked if he also wanted my permit. He said no. That was the extent of it. I guess I felt that if I was a cop in the same situation, I would appreciate someone being upfront just to inform. Like goperfect said, no duty to inform. I once overheard a discussion at the gun show in Middletown between a sheriff and some guys about this very topic. The sheriff said personally, he didn't want to know if someone he pulled over was carrying. Different strokes for different folks.

If you get your permit in Broome County you have to notify when pulled over in Broome only.

Here's my personal take on this.... I drive a commercial vehicle which, for some reason, automatically makes me more likely to be stopped for no reason. I generally have my wallet on the center console and not in my pocket. I keep my seat belt on and hands on the wheel until the officer is at my window. When he asks for my drivers' license, I hand him/her my license as well as my permit. I tell them I have one (pistol) on my right hip. It's never been a problem. They've never asked to see it. They have often thanked me for telling them.

The only time I've been asked to remove it was when stopped by DEC while hunting. I open carry my .357. They were doing a hunting license check. He asked if I had permit and then wanted to check the serial number against my permit. I offered to have him remove it from the holster but he declined and had me remove it. I opened the cylinder before handing it to him. Again, no problems.

As to knowledge... A little advice I will offer, the internet is not the place to "ask" legal advice that could either help/hurt depending on the situation. And a situation whereas you may encounter a traffic stop while carrying is certainly one where you need to be sure of a few things:

1. Know your RIGHTS!
2. Be sure to invoke your Rights.
3. Know how the law applies to the situation.
4. Know how to act/interact with Authority.

You decide to carry, you had better KNOW what is up and what is down. You can get 100 different opinions asking on the internet and ever exclaiming that this is where you heard it won't help you should you ever wind up in the wrong side of a shitty situation.

A traffic stop is more complicated than most as there is "Implied Consent" when driving a vehicle. Anything in plain view is free game as well. NY has no duty to declare simply, but not so simple is it? With the new NYSP registry going into action and it's link to DMV, I'm sure going forward there will be more interactions as you prescribe. But know this, stops occur because they can, ie, busted light, speeding, etc., justifying a stop is easy. NY has established case history and judgement that you cannot be stopped purely for the checking or asking if you are armed! But a safety check is within reason also. Lolz

Just be smart and don't sweat the small stuff! I'm sure if a poll was presented here, you'd find very few people ever checked in the manner you ask about.

I have been stopped a few times in my personal car and more often when I was driving my assigned government vehicle. It was a rare occurrence for a cop to ask me if I was armed. After retirement, and thus since I have had a license to carry, not one cop has asked me if I was armed. I doubt they know beforehand. If I stopped you and knew before the actual stop you were licensed to carry, you can bet your sweet ass I would ask if you were armed and I am guessing so would others in LE. That they do not ask probably means they do not know you ae armed or have a permit. Now, I think there are states in which pistol license info is put into the system and it comes up when a driver's license query is run but I am not sure if NY is one of them. I think MD is one.

Last time I was pulled over it was near Roscoe, NY. The officer, a county one as I recall, told me the bulbs over my license plate were out and that was the reason he had stopped me. I was not speeding, not swerving and not doing anything illegal. I informed him I was armed while both my hands were resting atop steering wheel and open. I virtually always do so in such an encounter. Bottom line, he said have a nice night and let me drive on. I checked the lights later - they worked. I brought it to my mechanic, he checked the lights - they worked and he could not find a short that would make them go on and off. Apparently the officer was lying to me about why he stopped me. No big deal. For all I know, he could have stopped me because my vehicle fit the description of a wanted person's car and he did not want to alert me if I was the bad guy. I am guessing though he stopped me because of the sticker next to my rear plate - the Unorganized Militia sticker. Even then, he did not ask if I was armed, I told him.

It has been ruled in a NY court that the police cannot ask you if you are armed on a routine traffic stop for a traffic violation unless they suspect you of a crime.

So they cannot ask you if all you got pulled over for was for rolling a stop sign unless they suspect you of something else. You also do not have a duty to inform.
