New York law currently prohibits individuals from obtaining a gun license if they commit certain New York misdemeanors that are deemed "serious offenses." However, the law does not prohibit individuals from obtaining a New York gun license after committing comparable misdemeanors in another state. These serious offenses include certain domestic violence misdemeanors, misdemeanor sex offenses like forcible touching, and unlicensed possession of a firearm. I am proposing we act to prevent those individuals from obtaining a gun license in New York. Gun violence in this country is a crisis. The cause is clear: spineless politicians in Washington who refuse to stand up to the NRA and pass common sense reforms. The solution is also clear: New York's strongest-in-the-nation gun laws which have made us the safest big state in the country. But until the federal government acts, states with weak gun laws will continue to endanger New Yorkers at home, and I will not tolerate it. NYS goes ever farther than whats on the federeal background check......believe me, I know.
On the 4473 they ask if you have been convicted of a crime where the sentence would be OVER 1 year in jail, even if you recieved a lower sentence.
In NYS there is a list of crimes which hold LESS than a year in jail sentences where you will be denied.
I was denied a gun purchase due to one of these NYS disqualifiers.
30 plus years ago I was found to be in possession of an illegal knife. I was convicted of 4th degree criminal possession of a weapon, which held a maximum sentence of UP TO a year in jail.
After 30 years of buying guns and getting a carry permit, that conviction finally caught up to me. I have sinse regained my rights through a Certificate of Relief.

Heres the story......
When I was 18 years old I was pulled over. I had a switchblade knife in plain view of the cop. He arrested me on the spot.
I bought the knife over the border in PA when I was 16 years old. I had no idea it was illegal.
The judge ruled I was not using the knife in a dangerous or threatening way so he gave me a $100 fine....case closed.
30 years later, after buying dozens of guns including handguns on my permit, bam....denied.

States like California, Oregon and several others are lowering punishments for drug use and possession. All the while overdose deaths in these states and many others keep going up every year.
Drugs are killing many thousands more people than guns but the liberal politicians keep decriminalizing drug crimes.
