Technically, Brooke was not served a Red Flag Protection order, but instead was given a letter from the Rockland County Judge. Judge Kevin Russo stated in his letter, “I have been advised that you have engaged in an ongoing course of erratic, threatening and harassing conduct.”
That’s’ all.
No accusers, no specific allegations, just that.
Even after Brooke filed several Freedom of Information Act requests with the different police departments involved, he got no answers.
In fact, his FOIA requests were initially denied entirely.

Chiefs occasionally sue to try to stay longer but they never win. We do have a few people left I believe who won a lawsuit years back, they may all be gone though. It only pertained to veterans. The last Vietnam Vet from that lawsuit retired only a few years ago and I believe he was 67.

Police claimed he threatened someone, revoked his pistol license and said he was prohibited from possession any guns. Gave he two days to transfer them. No red flag petition, no hearing, no "due process." Didn't need red flag if you have a pistol permit. Licensing officer can just take it. Preparing Federal Court Complaint. Anyone know the identity of attorney representing him. I would like to compare notes.

my police department and the ones around mine take guns for any domestic related incident. Crime committed or not, arrest or not. This is not hearsay my dad and brother are both cops on this force and have confirmed it and what’s worse agree with it. You then need to go to Supreme Court to get your guns back. I could yell at my wife and a neighbor could call the police and bam my guns are gone.

Even NYC has finally admitted this and gotten on board. We used to have to voucher our guns if not accepting a NYC permit upon retirement. We no longer have to do this. They give you an HR218 qualification card and you walk out.

Not sure if this is the case for all PD’s but if no pistol permit you need to qualify with each gun you own. My dad just retired and he doesn’t have a permit and that’s what he has to do.

HR218 only requires a retired officer to type of firearm he or she wishes to carry. If he or she wants to carry a wheel gun, they much quality with a wheel gun. If they want to carry a semi, they must qualify with a semi. They must meet the standard for qualifying in the state in which they reside or the agency from which they retired.

I have been through the exact scenario you list here, - the cops were called to my home; my gun taken temporarily, but returned at the end of the call; no charges all around, but days later the (now disgraced and former) OPPD Chief wrote a letter demanding my NY CCW be revoked. It was suspended, and I had to hire a lawyer and go to NY Supreme Court to get it ordered reinstated, and then got jerked around by the ECPPO and the OPPD to get my permit card returned, and later to get my guns returned to me.

NY doesn't actually need a Red Flag law (although we now have one...) They can just use the existing Penal Law to pull your firearms, - and then you have to go to court and fight to get them returned to you. The Red lag law just makes it even easier for them.

I believe this will continue to happen until NY's May Issue scheme is outlawed and changed to Shall Issue.

I have been through the exact scenario you list here, - the cops were called to my home; my gun taken temporarily, but returned at the end of the call; no charges all around, but days later the (now disgraced and former) OPPD Chief wrote a letter demanding my NY CCW be revoked. It was suspended, and I had to hire a lawyer and go to NY Supreme Court to get it ordered reinstated, and then got jerked around by the ECPPO and the OPPD to get my permit card returned, and later to get my guns returned to me.

NY doesn't actually need a Red Flag law (although we now have one...) They can just use the existing Penal Law to pull your firearms, - and then you have to go to court and fight to get them returned to you. The Red lag law just makes it even easier for them.

I believe this will continue to happen until NY's May Issue scheme is outlawed and changed to Shall Issue.
