The NYS court of appeals has already ruled that if a federal judge in one federal district finds against the state, it applies to the whole state. When the 2nd circuit upheld it, it also applies to CT. The “assault pump rifle” named is also now case law protected. So, if one is arrested by a police officer solely based on having 10 rounds in a magazine, the judge will throw out the charges and a civil suit will result in money for that person. That is in addition to any fines that court might impose.I don't understand what you are getting at. The 2nd Circuit applied it to the whole state. So the Western part only is no longer an issue.
Are you referring to the increase of the age of being considered an adult by the criminal justice system or just juvenile law in general?I’ve spoken to many cops and many DA’s don’t even want a thing to do with the safe act. My dad and brother are cops and most cops don’t even know the safe act. My brother still thinks that ammo background thing is still a thing and that if you didn’t know the safe act was a thing you have 30 days to register your gun. So cops don’t know the law.
The new juvinile law is even worse. The guy teaching the course to my dad didn’t even know it.
Defend my virginity plz.Absolutely that is what I'm here for I'm here for you man
I had a copy of the State Police handbook for SafeAct guidelines. It was updated to state that the limit has been reverted to 10 rounds. Also, stated right in their own handbook that they can NOT inspect your magazine to count rounds unless suspected of the crime of carrying too many rounds or a high capacity magazine. Thought I had it in my glove box in case some idiot wanted to give me a hassle but not sure what I did with it. Just moved this summer so I may find it again eventually.
This is the part that I refer to. I interpret it as needing more than the officer's suspicion of carrying too many rounds.I edited your post... Can only examine your magazine if suspected of "that" crime itself as carrying isn't a criminal act. Just because you "have" a gun, doesn't allow for it to be taken, searched, seized it whatnot... And the suspicion would have to be based upon some factual evidence, not a hunch or whim... Arbitrary search would be thrown out and likely result in a counter lawsuit for damages due to violations against unreasonable searches... Just saying!
Not going to be hard to make up an excuse to claim you are doing something unlawful but they better have a strong suspicion that could hold up in court if BS. I still can't find my copy so this is part of it I found on the web. Still looking for mine.If the weapon is one for which a permit is required, police will be justified in checking the permit to ensure that the person lawfully possesses the firearm. If a permit cannot be produced, the officer would be legally justified in seizing the firearm and conducting an inventory of its contents. In this case, the inventory would include checking the magazine in order to account for each round. However, if the person produces a permit and there are no indications of unlawful conduct, an inspection of the magazine would be unnecessary. In this case, the weapon should be secured temporarily, in the same condition as it was found, for the duration of the stop and returned to the motorist at the conclusion of the encounter.
The guide informs troopers they must have probable cause of criminal activity to inspect magazines: "Absent some indication of criminal activity, there is no right to inspect the contents of a magazine to ensure that it meets the requirements under the SAFE Act. ... The mere existence of a magazine, which may or may not be legal, does not provide probable cause to believe that any law is being broken."
Troopers may inspect magazines only if owners are unable to provide a permit for a weapon, according to the guide. If a permit is not produced by an owner who is questioned, police are authorized to seize a firearm and inspect its contents to account for the number of rounds, the manual states.
The western district court ruled 7 was vague. If i remember correctly that would technically only be counted in the Western District of New York, but if someone were arrested and it went to court that ruling would then stand for the entire state.10+1 rounds is the law on nygunforum. 7+1 rounds is the actual law.
Agreed.Forgive me. I thought the second ruling was the one made within the western district, so when upholding that decision, it only applied to that part of the state.
I'm not aware of this Will, what's the story with this. The Western district ruling is no longer relevant. The higher 2nd Circuit ruling is the only one that matters now.
Post Number 54 explains everything.I'm not aware of this Will, what's the story with this.
Why would the state update it when the ignorant will follow along like ducks. Here's the annoying part... From NYSafe Act - Gun Owners | SafeAct (just copy and pasted right now):
Q: How many rounds can I put in my magazine?
A: While at a recognized range, whether you are there for recreation or for participating in shooting competitions, you may load the full ten rounds into any magazine you have. Starting on April 15, 2013, you are limited to putting 7 rounds in the magazine in all other locations.

This isn't the penal law, just some website
So if you have 30rd mags you can put in 7 and that's ok? LMAO!! Why are 30rd mags illegal yet my 10rd mags are just fine if I were to load just 7? Pistol vs Rifle? How about I don't give a shit! We have children running this state.
Because 30 round mags are banned 10 round mags are not banned.
As a side note, even though it wasn't really enforced NYS banned 30 round mags long before the safe act.
Then NYS made above 10 round magazines illegal with no grandfather clause.2004 after the Clinton awb, but they grandfathered any magazine overy 10 rounds into the state if they were made prior to 1994, so you could the day after or even up until the day before the safe act, buy 30 round maga, just so long as they were made prior to 1994
Then NYS made above 10 round magazines illegal with no grandfather clause.
The only people who are allowed above 10 round magazines are LEO ;or other authorized government actors ( military etc) on official business, and more recently retired officers get to have the magazines for the specific gun they qualified with in their last 12 months of their employment and must requal to retain that magazine.
So any rifle magazines I would have had over 10 rounds still in my possession would be a felony since I didn’t qualify with a rifle in my last 12 months.
A retired cop friend of mine who had cancer and could not requal in his last 12 months before retirement can not keep his above 10 magazines.
WTF Here we go !!!! I’m assuming the criminal possession of a weapon was the primary charge and the 10 round BS was just for fun ?
4 Buffalo men charged with gun possession, SAFE Act violation
X2 on that !Came here to post this, just read it. I really want to see what happens with this
Still shouldn’t be a charge for 10 rds in a mag .The guys are fucked is what will happen.
1) weed in the car
2) pistol in the car and it is unclear of it was registered on a permit
3) they got another charge for the 7 rounds because of 1 and 2
One of the four will flip on the guy who actually owned the pistol when he see he is facing ass rape jail time.
This is a bad example as there were other reasons these guys got bound up.
