The lower of an AR is a firearm in the eyes of the law. So when you get it transferred to you as a pistol then it IS a pistol at that point and will have to be added to you permit the same way a normal pistol is.The transfer hasn't taken place yet. This is just to make sure I have my ducks in a row beforehand.
I understand the issues with transferring the lower as 'other'. But even though it will be transferred as a pistol, it is not yet technically a pistol. That's where my confusion is. If it is not a pistol yet then I shouldn't need it on my permit to have it in my possession. Provided I already passed a bg check during the transfer.

Of course I couldn't just stop with the setup I had. New rail and a New Frontier side charge upper. Along with a different muzzle device. This is the gun I really imagined when I started this build.
I'm done for. A few weeks ago I got my hands on another lower and stuck it on my permit. These things are a serious addiction, I swear.
There is no such thing as a "safe act approved" mag lock. Use what you feel comfortable with. I know of other devices, including the armr2 which drop mag when upper is opened, that have been confiscated. But go figure, these cases don't make it to court, and they don't for a reason. If you have the time and money to fight it, nys has a pretty week case as there is nothing in law to define what a fixed magazine is.Twax100-
Sorry for dragging this one up from the bottom but I’m doing a bit of research on a pistol caliber AR pistol and came across this thread.
I’m aware that nothing is 100% verified and we don’t have a concrete ruling to point to but from what I have read the type of system which you’re running on this pistol (mag release becomes operable once lower & upper are separated) is more than likely not “SAFE Act Approved” in comparison to the epoxied Maglock/bullet button system which seems more widely used. Can you comment on that?

Pm sentI’ve been dreaming up a pistol build but had a pretty negative conversation with Wolcott guns about putting a lower on my permit. They would not transfer a lower as a pistol and told me it’s extremely unlikely the PP office would place it on my permit. @Jem45472 i saw you are in Erie and did a build. Any advice on which FFL would be willing to handle the transfer and how did you handle the PP office.
Need the right FFL to do the transfer, then he'll give you a receipt with make,model,caliber, serial number. As long as you have the receipt, no problem at permit office. Don't get cute with the office trying to tell them what it is your doing. They won't ask questions as long as all information is correct on receipt.Pm sent
