ATF Prosecutes Ohio Man for AR Pistol with Brace

Luckily there was a happy ending to the saga, with the jury returning a not guilty verdict after a short deliberation. The most alarming part of this indictment is that the U.S. Attorney’s Office for the Northern District of Ohio even sought to prosecute the case. The [Prince Law Offices blog] (ATF Unhinged: Prosecutions Made Up Out of Whole Cloth – You Might Be Next…) went as to far as saying the U.S. Attorney’s Office invented the charges ‘out of whole cloth,’ completely fabricating the entire basis for the case.

If you can be charged and taken to trial with 12 random community members screened for their ignorance left to decide whether or not the pistol + shoulder brace is illegal and you will go to prison, that tells me all I need to know about whether it's legal enough for me.

A jury decision on a matter of fact is not a binding legal precedent against future prosecutions.

FFL tried to sell me a brace for a Shockwave. "No thank you!" I'll stick to my 18.5" barrel for the buttstock.

Edit: The ATF "approval" letter is a mess. I don't want to dissect an "analytical framework" to determine whether a gun is felonious under federal law in a state like New York. What a jury does with that "analytical framework" is a real roll of the dice in some of the communities we may find ourselves in (and federal jury pools can come from a very wide territory).
