Text of Bill, as proposed.
Does eliminate class 3 registration, and past records, but requires 4473/NICS check and a A MFG SERIAL NUMBER on the device for the NICS check.
Home made are not apparently going to be legal.

I can stamp a serial number as easy as the next guy.
Plus there's no NICS if it doesn't go through a dealer, so no need for one for that, anymore than any other 80%.
Hmm, that brings up the possibility of 80% suppressors..... "here's a bag of K-baffles and the end caps, you just need to drill them out for the caliber you choose, and supply some EMT conduit..."

The bill, as written, clearly says that Suppressors will be treated as......FIREARMS.
Meaning a 4473 and NICS.
The Serial number must applied by a licensed FFL Mfg...........is required.
Ghost Guns, as we know from the SCOTUS Vanderstock Decision, and now Ghost Suppressors, too are apparently illegal, by this law.
Omission can be the same effect as a prohibition...if it does not say home made suppressors are legal, and it is not in the law as legal............ they are now considered by law, as Firearms, as written in the text.
"Home made" is not included for a purpose.............protects suppressor manufacturers.
Like Ghost Guns, that cannot be sold without a NICS and a new Serial Number, the suppressors are treated the same way.

A dozen years ago I emptied my model 70 bolt action on running whitetail. I had it singing like a finely tuned auto loader. Five rounds of 7-08 caught the attention of two of my good local friends who enjoyed my less than fine deer dressing skills, they fed me fresh beer, helped load it into my atv too. This would've never been possible with a suppressed rifle. The moral of the story is loud guns = help and cold beer.
Ps.. if someone would ever make a flash enhancers (they must be legal because it's the opposite of flash suppressors) I would definitely buy some.

This is not Europe where it has to be in the law to be legal. It has to be prohibited by law to make it illegal. Omit something in the law and it is legal until the law is changed. 80% frames/ receivers without serial numbers are not illegal to own or manufacture (Federal, In states like NY and CA they are) into guns and making a gun from a block of metal is not illegal either. If the words are not there then it is legal.

No, the GC Act of 1934, and as amended in 1968/86 specifically prohibits the possession of parts that can be used to create a suppressor and other weapons................this is not being changed...... that means home made is not going to be allowed.

The GC Act is not being changed except to remove suppressors from it, but still requires that a suppressor, that is NOW considered a firearm......HAS TO BE mfg by a licensed FFL MFG, WITH a serial number........... and a 4473/NICS IS required.
Ghost Suppressors will likely get you arrested, like most Ghost Guns going forward, after the Vanderstock SCOTUS decision.
FRT triggers and bump stocks were not specifically listed as controlled by the GCActs, and SCOTUS said that the law as written.....one bullet with each pull of the trigger IS LAW.. as written by Congress in the GCActs.

4473 and NICS and a serial number are not required for a homemade gun.
In most of the US it's perfectly legal for me to build a rifle from scratch and never put a serial number on it, or even tell anyone it exists.
The SCOTUS ghost gun ruling was about selling kits. It says nothing about building guns.
You can buy a solid block of aluminum anywhere (even Amazon) and mill a receiver out of it without any legal impediments.
Everything else is just parts, and there isn't a practical way for them to ever change that. Unless they require a serial number and FFL for every piece of metal sold in the country.
Tell me that NYS does not monitor the sale of LPK's into NYS..........

It's perfectly legal to make homemade suppressors, and has been forever.
Even machineguns were legal to make at home up until 1986.
You just have to file the paperwork and pay the tax.
If this bill removes the tax and the paperwork, then that's the only thing that changes.
An FFL and SOT are only required to be *in the business" of building things. If it's a hobby, for personal use, neither of them have ever been required.

Except, without the tax stamp, there's nothing required for you to *do*.
If they no longer have to be registered, because the tax no longer has to be paid, then all of that goes away.
