Changing Address

I am considering a move to another county in the near future, and a friend of mine told me that I would need to alert my county clerk about the move so that an amendment can be made to my permit. The move would be to a county (outside of NYC) that has a more restrictive attitude towards gun rights in comparison to my current one. Even though I was told that I could have my file kept at my current county despite residing in a different one, I was wondering what happens if I choose to just not tell the county about the move. Has anyone ever had their permit suspended/revoked for failing to inform them about this change? Even if the state requests that you alert them that you moved within a set period, do they even have any reliable way to check this presuming that you keep the same address listed on your driver's license? It just sounded invasive to me that they would demand that you let them know your exact permanent address at all times. I don't want our state government to know where precisely they can find me at a moments notice, and I certainly do not want to give them the information unless I absolutely have to.

Well, by law if you change address you are required to notify DMV within 10 days as with the clerks office. You'd be in violation of whatever statute for DMV and PL400 because the handguns have to be at the same address as you reside which needs to match what is on your permit and drivers license. Failure to notify of address change may result in your permit being suspended or revoked. If you are moving to an adjacent county, you may be able to keep your current county permit but that is up to both the counties and licensing officer (IE if you live in Columbia county, but move to Greene county, you may be able to keep your Columbia county permit/judge). The drivers license is one thing, I wouldn't risk it with the PP. Because the two are linked (address requirement) I wouldn't advise you try to cheat the system. Not worth it.

I thought that only a premise permit requires that you store your handguns at the same place that you reside in. It was my understanding that so long as you have a carry permit you can store them anywhere you like (so long as it is outside of NYC)

I may be wrong here, but this is how I understand it. Best thing would be to call your current clerk and ask. Perhaps even call the clerk for the county you are planning to move to. Sure you run the risk of raising red flags, but in NY when it comes to handguns, it's best you follow the law.

I made a permament move out of NYC 25 years ago. We moved directly from one NY address to another. I had to notify NYPD that I was changing my address and voucher my pistol to the Orange County Sherriff while my application for an Orange County License was considered. It took about a year for the process. Since I kept membership in my NYC pistol club I was able to get a NYC addendum to my Orange County License from NYPD which took about 3 months. If my move had not been permanent I could have kept my NYC license. Buying a house and moving 2 children and Mommy is considered permanent. My brother still lives in my former apartment.

Well, there are exceptions if you go through the proper channels and wait the wait, pay the fees Etc.. But for me (a NYS pistol permit holder) to bring a handgun into NYC) would be illegal without the proper permissions from local authorities. Same for someone from NYC with a NYC pistol permit going up state. Their permit wouldn't be recognized.

Yeah, so you had to voucher your handgun(s) with the county sheriff while you went through the NYS permit application (even though you had a NYC permit) to continue to be a legal owner of handguns.

I think everyone on this forum agrees. The permitting scheme here in NY is complete unconstitutional BS.

To my knowledge (lurking this forum) this is not correct......But the laws are so convoluted, I don't even think the NYPD even knows what they are. Maybe this was 25 years ago before you moved, but in todays day and age I don't even think NYC residents are allowed to even take their guns outside of the 5 boroughs unless on some sort of "special hunting authorization"

I don't see how that makes any sense. That sounds like BAD info. Maybe it's different with NYC "Target" license, but a "premise" permit definitely wouldn't be valid upstate.

NY Law references cities with a certain level of population. It is State Law, NYC didn't promulgate it. Our upstate legislators passed it.

When I got my Orange County License, since my membership in my NYC pistol club was still current, I went to NYPD and applied for a NYC addendum to my Orange County License. It was a seperate piece of paper and looked just like my former NYPD issued NYC license. It was a target permit.

It only said target, restricted, not for carry. I still have it in the file. I asked about fishing not hunting, because I didn't hunt back then, and was told as soon as I left the 5 boroughs I had an unrestricted license.

I can't imagine that some rich guy who has an unrestricted NYC carry license cannot carry in NYS outside of NYC.
