Converting Pistol to Firearm/Other

I know a pistol can be converted into rifle and back again. I also know that once a rifle, always a rifle. It cannot be converted into a pistol. If you do so, it becomes a SBR.

What about a pistol to a Firearm/Other? And perhaps back again? For those that do not know what a Firearm/ Other is, it’s a firearm that’s just classified as a Firearm by the ATF since it isn’t a pistol, rifle, or shotgun kind of like the Mossberg Shockwave.

Like if you have a fixed mag AR pistol with an Arm Brace that’s over 26 inches in length, add a forward grip, and then remove the mag lock.

Or you have a Glock 17 for example and add the 10 inch lone wolf barrel and Roni chassis to make it over 26 inches?

What about a stripped lower you had transfered to you as an "other" that you initially built into a rifle, but move to a free state and turn it into a pistol? I'm assuming since it was transfered as an "other", once out of NY, I can make it into either a pistol or rifle at will, so long as I fix it with the appropriate components per build.

It was a stripped lower that was transferred as an other, not a rifle. I built it into a rifle initially but the atf doesn't know that. As far as the paper work goes, it's still an "other". It's just NY's bullshit pistol laws that are a problem.

It's so dumb man, it doesn't make any sense at all and is completely unenforcable. The controlled component (receiever) is officially transefered as an other. You don't officially report it to any government agency as what you build it into after that. So it remains an other. Barring any proof that you have the same lower on both a rifle and handgun, there is nothing you could be charged with.

Just like no one would ever know that you temporarily took a mag lock off but it’s still a crime.

The only way that I can see getting caught is if you posted it online. Like for example, you posted your 9mm AR with a Thordsen stock and later you post the same gun with a pistol brace. Obviously the numbers would have to show. Or if that’s the only AR you have and there is no record of you ever buying another receiver. Or if there was ever an official encounter with your rifle like with a DEC agent or something in the field and later that rifle is a pistol now. Things like that. Rare but could happen.

Technically once it is a rifle it's always a rifle.

The "what it started as" mattering is about what the paper trail can prove.

If you buy an other, build a pistol, convert to a rifle, you cannot legally convert it back to a pistol, but the onus is on a prosecutor to prove it was once a rifle.

If they really wanted to they could take that facebook picture your cousin posted showing you with it as a rifle and prosecute you.

In the real world, they only look as far as what it left the factory as, but there is nothing in the law limiting them to that.

That’s not correct. It’s the other way around. The ATF actually has letters written that say that you can do pistol to rifle to pistol but not rifle to pistol.

4473 a reciever is an other.

These "I want an NFA loophole" items should be in your head as "other firearm" or frankly in my mind just "firearm".

Which of course gets weird in NY because in the Penal Code "firearm" has a totally different meaning.

Anyway, does anyone know if you can turn a pistol into a firearm and then back into a pistol again? In this case since our pistols are registered, it matters.
