A ruling from the 6th Circuit Court serves as a warning to dog owners: Teach your dog to sit still and be quiet or risk police justifiably shooting the dog.

"The standard we set out today is that a police officer's use of deadly force against a dog while executing a warrant to search a home for illegal drug activity is reasonable under the Fourth Amendment when, given the totality of the circumstances and viewed from the perspective of an objectively reasonable officer, the dog poses an imminent threat to the officer's safety," Judge Eric Clay wrote in the court's opinion.

Bottom line, no search warrant, no entry. All business to be conducted on front porch. I've seen perfectly friendly dogs come of as aggressive to people who don't know them. I understand and agree with the LEO point of view. The intent of this ruling is cut and dried.

These scum bag mutts who have dogs on premises for the sole purpose of attacking the cops when they execute a search warrant, should understand that the dogs will be put down. Very cut and dry.

Too many people have no clue how these crims think and act. Some may think they understand but have no clue. They do not have dogs to love and nurture, they have them to attack anything that comes their way. The judge is not giving Carte Blanche to shoot every dog the police come into contact with.

I understand the intent. But a jacked up cop in the heat of the moment worries me. My dog will bark and go to the door if he hears someone at the door or come in. He loves people and always greets people happily if not some times too joyously. He also likes to jump up (something that's been hard to train out of him).
If they started doing mass confiscation of guns in this state or came through on a no knock for whatever unforseen reason or if they got it wrong and had the wrong house/apartment (it's happened) I seriously worry about one of them shooting my dog. Which would enrage me and most likely get me shot.

I know that. And again I completely understand the cops side of it. My girlfriend works at a vet clinic in an urban area and you wouldnt believe the nasty dogs and owners she's encountered. It would make you sick.
That being said, there are instances where the officer fucked up and did the wrong thing. One I can think of off the top of my head was when an officer responded to an eviction related call (non-emergancy). The people being evicted had to leave their dogs out in the yard until they could find some place for them. The landlord called the police and animal control. The officer arrived first and rather than wait for the animal control officer to show up and handle the situation, the officer entered the yard and cornered one of the dogs. It ended up trying to grab the officer and the officer shot it through the face. The dog didn't die until it got to the clinic. In this case, which was non-emergency, the officer made the wrong move. The dogs were contained, minding there own business in the yard. He could have just kept people out of the yard until the animal control guy showed up to handle it.
A lot of "dog attacks" happen because people are not aware and end up making the dog feel threatened. Unfortunately, it's the dog that usually ends up paying the price for someone's ignorange and stupidity.

I get the court's decision. No problem with it. But, this idea of a subjective feeling of being threatened by an animal and countering the threat by killing the animal is a bit of a stretch. Equal force, what dog can kill a human by biting and barking and jumping? Maybe pepper spray or taser, but a 45HP to the face ? Stop the aggressive animal does not always = killing. Yes I respect LEO. No I am not being argumentative. Merry Xmas and God Bless

ETA Perhaps if the police depts actually did respect life and property there would be a research project undertaken to set a protocol for repelling aggressive animals short of killing them. Less than lethal weapons, tasers, nets, drugs, sprays, and I am not even a researcher. Just shoot it? C'mon, man.

I do not and have not participated in anything drug-related, so I theoretically have nothing to worry about but !
my 30 pound dog will bark at anyone who I don't let in.

Seems real stupid to start shooting I believe that precedent has already been handed down!

Most dogs will notify you, before you know, by barking that someone is close. The intent of the law may he good. The results will be variable.

All dogs react to people based on a sixth sense. Anyone who enters your house on a search warrant is going to have heightened awareness and will be pumped up - I would be. And the dog will know this and react with hostility. Our Westie reacts very strongly to a couple of people that come I to our neighborhood. Both are shitbags. He's never met any LEOs.

I'm torn on this one.

The issue I have with the court is they feel that this will deter criminals from doing this. They sell drugs that ruin and kill. Why do you think this will deter them. I agree with gopeferect 100% and his assessment. My dads been a cop for 32 years and never had to shoot a dog. It does not happen very often. The other issue I have that is not a situation that can be remedied is its not really the dog fault. I understand people come first, but the dog is just doing what it was taught. They should hold these criminals accountable for the dogs death too and add more jail time. That is until Obama parsons them as usual.

She was asleep in the back seat of the truck I said hello to the trooper, had my wallet opened on the dash and window down, trooper said ok and waved for me to keep going and the dog growled.I told the trooper I didn't teach her to do that, he looked a little ticked off.

Pepper spray does not work on Dogs. Trust me. I have sprayed a whole can on one and all he did was to lick it up.

Every year the Pepoer spray companies swear that the new mix will work on Dogs and every year they are proven wrong.

As far as Dogs killing people, it has happened. And the standard to kill a human in self defense includes serious physical injury is about to be committed by the perpetrator. And animal is a lessor standard.

I have personally seen a pit bull bite take a chuck out of someone that you would have thought a shark bit them. Some dogs also go to bite the genital area rather than an arm. Sorry but with those choices, the dog "has to go" .


Here is a case of a dog getting shot. Please remember they slowed the video down. The cops did not knock on their door but a neighbor's door, yet they let the dog out.
