How many have gotten a delay? I am attempting to get my first gun and started this process 2 1/2 months ago. I attempted to buy a Mossberg 308 from Walmart and got a delay before I canceled that order. Tonight I just got my second delay on the same AR lower. Was even told by the gun store that if I was in any other state I would have had my lower 25 days ago. This is gotten beyond frustrating and could not feel more like infringement.

Could you clarify what you mean by delay? Is it a delay in shipping? A legal delay?

Delay has nothing to do with the State. Thats simply what happens when whomever at the FBI hasn't been able to run or complete your BGC. Could be someone with a similar name has a criminal record etc.
My only delay ever was picking up my first handgun. It was Friday after work. Had range day all setup for Saturday. PISSED.

In other states you don’t have to wait 30 days for a delay. If the NICS doesn’t come back in 3 to 10 days in other state’s you go pick up your gun. In NY it is 30 days which means you have to do another NICS check and if you get delayed again your 30 days starts again.
The problem is the new state law can basically keep you locked into a non-stop 30 day merry-go-round. The NICS expires in 30 days and NY requires a 30 day hold for any delay. So once NY releases you from your hold your NICS has expired and you start over again.
Applying for a unique identifying number can take months or even up to a year or longer.
There is a guy here who had to get someone on President Trump's staff involved to get this same issue resolved for him.

This is specifically stated in the form. That being said... 2 Back to back delays? Very Odd... But that just might be due to the sheer volume of new applications since all this BS in the US has started. July was another monster month for BC's in NY. 45,000 in July, 52,000 in June and 59,000 in March... The average in NY for 2019 25,000 a month... So 200% increase give or take... Amazing how many people have jumped on the PewPew Train.... ALL ABOARD!!!!

I would like to say you can just by voting for Pro 2A people or demanding elected officials like FUAC uphold the 2A instead of tearing it apart, but that ship has sailed in NY, and pretty soon, the rest of the country. If more people had been proactive in the debate over the 2nd instead of being silent while the 2A was relentlessly assaulted, had exercised their 2A rights instead of taking them for granted, thinking "I don't own a gun so it doesn't involve me", then maybe... But now... It's too late. And all the NEW gun owners who shunned the mere idea of having one until they realized a SHTF scenario CAN and MAY actually happen, well, they are finding out exactly what us OLD gun owners have been saying all along is actually true... Making tougher gun laws only takes guns from law-abiding citizens... I've been a shooter for 40 years and I refuse to vote for officials who intentionally violate or plan to violate our rights as citizens to keep and bear arms... All other topics aside... Mine was a denial and took 3 years and an act of POTUS power to fix.
A friend of mine gets delayed everytime he buys a gun for the last 30 years.
Hes so used to it now he just plans on it.
No clue why, his name is very, very unique and hes never been arrested or does he have any other disqualifier.
Some people just have the luck.
Now my NICS comes back within 2-3 minutes.
For the UPIN (unique personal identification number) you have to send in your fingerprints and info. Then youre application is added to a pile and waits for human contact. The site says they are processing from Aug 2019 right now.
A friend has been waiting 19 months just for a UPIN.
FYI, I have a UPIN and have been denied the last 2 purchases. Both have been appealed successfully in less than a week but nevertheless, kind of defeats the purpose of a UPIN. So anyone who thinks a UPIN is the answer to solve all their NICS issues, I’m sorry to piss on your cornflakes , but , no. Government efficiency at its best.

NICS stop looking after 3 days.
If you don't get a proceed in the first 3 days you never will. They assume (correctly for 49 states) that 3 days turns into a proceed automatically.
NY makes you wait the extra 27 days to try again just to be dicks.
But......
With a UPIN your appeal takes a week if denied. Without a UPIN a denial appeal will take years. You dont appeal a delay, they resolve themselves either through a proceed or denial.
Over my almost 3 year endeavor with a NICS denial appeal I talked to many FFLs and government people.
The FFLs all said a UPIN can be invaluable for someone who has been denied or someone who has a common name. There is a big difference between 1 week and 3 years.
The 2 FFLs I know personally said they have NEVER had a UPIN holder get denied. A couple delays but they resolved themselves.
You dont appeal a delay, just denials.....which take years to appeal. The system is screwed.
I used to get delayed for the full 3 days. Then I got denied.
2 years and 10 months later and a call to POTUS finally got my rights back.
The FBI HIGHLY suggested I get a UPIN and I did.
Now my last 6-7 gun purchases have gone through in less than 3 minutes.
A UPIN may not be perfect but its really really good if you need it.

Wrong if your delay turns into a proceed overnight or within 29 days the FFL can transfer the gun. The law changed the rules on the transfer while in the delay status. it used to be 3 days now it is 30.

Ive told this stoey before but.....
A few years ago a local school teacher was found shot to death in his yard.
The cops had no clue who did it but they had the shotgun used in the crime.
Two days later they had the perp in custody.
The cops went to the local gun shops with a serial number and found who bought the gun.
Turns out the shooter had an affair with the victims ex wife so someone had to die I guess.
Anyways, handguns already have a full registry and all long guns sold are on file at your FFL forever and can be used by LEOs.

For me, it's more a matter of principle and law than anything else. The feds are not supposed to keep that information as a matter of law- but there's nothing prohibiting them from creating a database of purchaser info if its given over voluntarily. It bugs me that they set up a system that encourages this through bureaucratic inertia. If their system worked as intended no one would need a UPIN.

Don't forget, if they trace a gun through an FFL, they have a habit of just copying the whole bound book during the investigation.
How many FFLs never have a trace ?
I wonder what % of sales they have records for in government custody.
