Democratic lawmaker warns against convention to change N.Y. constitution

State Senate Democratic Minority Leader Andrea Stewart-Cousins is the latest state leader opposing a push for a convention to make changes to the state constitution.

“While the intent of one may be good, the reality is much different,” Stewart-Cousins told the Daily News Monday. “In this dangerous era of Trump there is a concern that powerful corporate interests will try, and possibly succeed, in making fundamental changes to our State Constitution that are antithetical to our New York values.”

The Yonkers Democrat is the latest legislative leader to oppose the measure. Only Assembly GOP Minority Leader Brian Kolb backs a constitutional convention.

“There has been a lot of talk about what can be accomplished through a Constitutional Convention, but the State Legislature can and should be passing voting reforms, ethics reforms, real redistricting reforms and a whole host of other critical priorities, and not relying on others to do their jobs,” Stewart-Cousins said. “While I do not support a Constitutional Convention at this time, I will continue to fight for Democrats in the State Senate to unite so we can pass all of these priorities."

Could you imagine, NY enact it's own 2nd Amendment? I mean seeing as it doesn't have one, what could be more necessary? There's little hope it would, or even could pass this year, but it'll be fun to watch them sweat!

My thoughts exactly. I realize it's not without risk but how much worse could it get. I say go for the Constitutional Convention.

Im not sure a CC would bode well for the dems.
Its my understanding that all NY counties have a near equal say in the new "rules", and with 90% republican counties, they may not be able to get rid of guns and open our borders.

The last constitutional convention was in 1967. My thought process tells me that conditions were MUCH better for New Yorkers as a whole then than they are now. Opening that thing up in modern times will be fraught with legalese and other bullshit that will instantly be written into LAW. No proposals, no votes... instant ratification from a select few that will most certainly negatively affect gun owners and others for decades.

A failed argument otherwise we wouldn't even be having this conversation or would the State need or any State need their own Constitution at all. State Soverienty is intact...

It's all moot point as the State politics are not red/blue, but purple across the board! It'll never happen, but I'd love it just to see all the snowflakes scramble!

Nobody has used the "the second does not apply to the states" since then, and even the gun grabbers have stopped using it.

The 2A has as much force as any state law or ammendment coukd ever have, and that point is even conceded by the gun grabbers.

Adding an identically worded ammendment to any state constitution would have no effect, either real or official.

Show me one case since McDonald where it was successfully argued that the 2nd doesn't apply to the states. Hell, show me one where they even tried it.

All their arguments are based on the case not meeting the criteria for protection, not that it doesn't apply because it is federal.

If they claim that AR's aren't "in common use", or that standard magazines aren't covered that doesn't change just because it is a state instead of federal law.
