It seems crazy to me that the judge rejected his 2nd Amendment argument because he didn't apply for a license in New York City and thus doesn't have standing. He's facing 18 years in jail, but he doesn't have standing.

I'm surprised I missed this one, and I think it deserves a LOT more attention than it's getting. What do you guys think?

Thanks for the article. I'm going to contact the reporter and find out what source he used that states what this judge said. This has spread like wildfire and the only ones talking about seem to be anyone that has a website or YouTube channel. None of them state their sources. I'm wary of propaganda from any side of the political spectrum.

Who had a license to make firearms in the 1700’s ? Was there a “permitting office” in 1783? I’ll take a WAG here and think there was no ATF then either.

It technically is not illegal to build in NY, but the jumping through the hoops necessary make it pointless and impractical. If one could find a O7 FFL to serialize a 80% and then transfer to the builder it would be legal as far is NY is concerned. Serializing and transferring a "non-firearm" Federally is another story, there must be a means to do it though as plenty of pieces of tubing were serialized pre '86.
