The community rallied behind the business and they village of kenmore has dropped the suit to steal their property. The village will now do what was impossible a few months ago and add a second story. I hope they get their legal fees reimbursed. I know don’t laugh.

I have been involved with eminent domaine.
Another example is the Ed Pink racing shop in LA, being taken via ED for Olympics bus stops.
ED can be sued for just about any public purpose that the gov't entity sees fit.
In Utica Ny it is being used for a New Hospital, sports arena and parking gargaes.
It was used in Utica, as a bridge was cheaper to close on Barnes Ave, and buy out the businesses on that street.
Politics and corrupt politics is behind the scenes.
As an engineer I once had to sit with an old mafia chieftan about what we were taking from him.....real entertaining guy....he explained to young me, that it was always part of the secret local political committees and banks, ordering the DOT to do what it wanted................same with Carossel mall in Syr. whatta mess. Moved Rt 81 we did for them all, 40 years ago..for free.
Bid dig in boston, Westway in NYC, and many other much older Robert Moses projects all were ED, as was all Interstate Highways, Mental retardation and mental Hospitals, etc etc SP Stations, etc.
Many NY smaller municipalities do nto follow the Feder regs and cheat the landowner out of all sorts of peripherals like moving costs, supplemental payments, etc etc.........
