One is the justifiable use of deadly force to protect property! So there doesn't even need to be a threat of loss of "life" or grievous bodily harm, just the simple fact that someone is stealing something owned by you. In this case, the attempt at robbery is clear. Proclaiming intent to kill someone is just icing on the cake!

Actually, now the mother is saying he had a "deteriorating mental state". So she KNEW he was turning violent?
Police suspected him in another armed robbery. Didn't "mom" discover his sudden cash influx?
What was she doing while he was deteriorating?
Then she complains that a father, protecting his family and others, used more than one round. The father wouldn't know if the perp would immediately drop his gun and surrender after the first shot. You shoot to end the threat completely. Not have some pain-ridden, mentally disturbed, armed individual shooting people at random.

So, the mother doesn't think he deserved to die for what he did. She's right. If he had survived and been charged his sentence would have been a couple years at most (more likely months).
Of course, you don't deserve to die for speeding either, but 120MPH on a 45MPH curve and you might get killed there too.
