FFLs shutdown in New York

Who on this site here is an FFL as well?

I just got a letter need a phone call from the ATF saying that since Gun Shops are non-essentail businesses in New York State that are shut down. So in the ATF's view that means that FFLs in NYS can't do business and therefor are shutdown.

A buddy of mine downstate who is an FFL got the same notice and as he is police he stated that ATF sent that notice to police departments along with a 211 page document listing all the FFLs in NYS.

So what other FFLs on this site can confirm that they got the same notice?

This is an important message from the Bureau of Alcohol, Tobacco, Firearms and Explosives. Pursuant to New York State Executive Order 202.6, non-essential businesses have been directed to close during the COVID-19 pandemic. Licensees can visit https://esd.ny.gov to determine whether your business is subject to closure. Licensees that are suspending operations should take prudent measures to ensure the safekeeping of firearms, ammunition, and records. Licensees may be requested by ATF to return to the premises to respond to firearms traces. As a reminder, immediately report any burglary or break-in to your local ATF office and to local law enforcement authorities.

An FFL is obligated to follow the rules of the state tehy are in. The executive order is telling non-essentail businesses to shut down. Gun Shops are not on the list.

Requests by businesses to be designated an essential function as described above, should only be made if they are NOT covered by the guidance.
Restrictions on requesting designation as an essential business:

  • Any business that only has a single occupant/employee (i.e. gas station) has been deemed exempt and need not submit a request to be designated as an essential business.

Let alone Firearms are a Constitutional Right! Have they suspended the Constitution, State or otherwise? What other rights have been suspended? If it is anything, it is one of, if not, the "MOST" essential.

Non-essential or not. Sole owner / proprietor is good to go..
I'll be curious to check on the store Runnings this week. Tools and farm equipment keeps them legally exempt from closure but will there gun counter be open ?

Why not? It's not as though grocery stores shut down the toilet paper isle.

An entity providing essential services or functions whether to an essential business or a non-essential business shall not be subjected to the in-person work restriction, but may operate at the level necessary to provide such service or function.

Ever sell to or provide a service to a cop, fireman, security guard, or employee of another business? Good to go as far as I can tell. And it doesn't say you have to service them exclusively.

I'm a sole proprietor FFL and this is what I am basing my continued operations on.
Traditional brick and mortar gun stores may need to close, but I don't see how they can tell home based FFLs that they can't operate, based on the language quoted.
I'm sure that Cuomo will correct that in his next "guidance"

For now, the main concern for me is the suspension of issuance of purchase coupons, the long wait periods for background checks, and some internet gun sales sites such as Classic Firearms putting right on their main page that all transfers in NYS are suspended and that dealers can't even accept firearms. This is not correct, based on the language above

Just came back from Runnings in Rome. They're open and selling guns.. lots of f#%king guns !!
I've been through all the gun threats and political attacks back through the California shootings during Bill Clinton's first term. Through the days of Obama and our own NY SAFE ACT here at home. But Corona has out-sold more guns than all them put together.

I don't have accounts with Davidsons or Lipsey's, as they flat-out don't consider me to be a "real" FFL worthy of doing business with them
But I've had an account with Zanders for years and have placed multiple orders with them in the last two weeks.
In fact, I got a call from my sales rep today asking me if I wanted some stuff that's been on back-order.
Of course I did.
And while I was at it I put an backorder in for another couple thousand in inventory.
I'll see it arrive at some point

Looks like they removed thier messages, on sites. Zander also has new mesage stating that they are essential.

Hope stock starts showing up
