I don't know anything about counting rounds in lockport. I have read the state police policy on the issue of when they can check how many rounds you have in a pistol. It came down to this. If simply checking to see if a person has a permit you can not check the magazine for bullets. A probable cause issue. With an automatic you get seven in the mag and 1 in the chamber. Yea I know you want more and so do I but I can survive on 8 rounds.

NY(UN)SAFE originally called out 7 round magazine limit. Judge Scratchy Balls ruling overturned that in the western federal court district of NY, "allowing" us to carry 10 rounds when in those specific counties that are basically west of Rochester. Supposedly, NY State Police have said they will go along with allowing 10 rounds across the state.

I'm pretty sure the original one in Lockport was a couple of years ago, and that he was not carrying 15 round mags, but 10 rounders with 10 rounds loaded. The cop wrote him, and he had to go to trial where the search was thrown out as I recall.

My county clerk still has the 7 round limit posted. The Unsafe Act website still does too. It's a mess.

Back to the OP many Counties that restrict license's have Rule and Regulations on the restrictions and some you have to sign off on to get your license! Some you are just told by the instructors that give the safety course, And they give them as instructed by the Judge it is not their opinion on what the restrictions mean but the Judge's.

He's correct. You can be charged a felony for possession of a large capacity ammunition feeding device if charged under Criminal Possession of a Weapon in the 3rd Degree found under 265.02 Section 8.

For purposes of this subdivision, a large capacity ammunition feeding

two thousand thirteen which amended this subdivision, that has a
capacity of, or that can be readily restored or converted to accept more
than seven but less than eleven rounds of ammunition, or that was
manufactured before September thirteenth, nineteen hundred ninety-four,
that has a capacity of, or that can be readily restored or converted to
accept, more than ten rounds of ammunition; or


(9) Such person possesses an unloaded firearm and also commits a drug
trafficking felony as defined in subdivision twenty-one of section 10.00
of this chapter as part of the same criminal transaction; or


(10) Such person possesses an unloaded firearm and also commits any
violent felony offense as defined in subdivision one of section 70.02 of
this chapter as part of the same criminal transaction.


Criminal possession of a weapon in the third degree is a class D
felony.
