These types of cases need to go to the supreme court ...
They won’t even follow the 2nd Circuit Appellate Court and change Penal Law 265 to drop the 7 in a 10 rd magazine.what good would that do .. NY won't follow Heller .. still waiting to see what happens with the NYRPA case .. oh we changed the rules ..
last i looked at the US Constitution .. still reads the same ..

Nope. The cop not honoring his oath is to blame. The citizen has a right to carry here in NY and defend himself.I do not like the laws in NY state.
It is very easy to research a tiny bit prior to coming here from another State.
I can carry everywhere in the US due to my employment, prior to going to another State, I look up all of their rules and laws to ensure I stay compliant.
It is really easy to do.
The one arrested is to blame.
Nope. The cop not honoring his oath is to blame. The citizen has a right to carry here in NY and defend himself.
That’s like me blaming you before you were a cop when you carried in places that the government told you that you couldn’t carry like schools and post offices if you got caught. You were exercising your rights to protect yourself and if you were arrested, the cop who did so would have been an oath breaker.
He would be the one to blame for violating your rights. Not you.
Nope, his fault. Personal responsibility to understand Rights are violated each and everyday.
Prior to my current employment, I carried everywhere. Well everywhere when metal detectors were not used. If I were to have been caught, it would have been my fault.
I get it, many people do not believe in personal responsibility, I do.
And that’s a violation of the constitution because you are forcing someone to not remain silent or you’ll throw them in a cage.Take North Carolina for example, in that State, you have a duty to inform an officer if you are carrying a gun. If you do not know that while traveling, you will get jammed up.
It makes no difference if you agree with that or not, follow their laws or face the consequences.
It’s a great analogy. You are blaming the victim for not obeying an unjust law.Horrible analogy. Not even in the same realm
And that’s a violation of the constitution because you are forcing someone to not remain silent or you’ll throw them in a cage.
What is it that you saying exactly? That the laws are constitutional and that you should take responsibility for having your rights violated? All this is fine. You do your thing, I will do mine.
When I travel to a different State, I will continue to protect my freedom; I will continue to take personal responsibility.
What is it that you saying exactly? That the laws are constitutional and that you should take responsibility for having your rights violated?
And other law enforcement officers too. You cannot take the blame away from them for not honoring their oaths. Because without enforcement, laws do not mean shit. Just like adultery laws. No, I find these laws to be very Un Constitutional. Makes no difference what I think. What occurs in reality is just that; reality.
I will not allow myself to get jammed up and my freedoms lost due to some asshole politicians.
And not the one who enforce them? Why? They are the ones that make it happen. My blame falls on those that create these laws and the Judges that uphold them.
Yes it is. Look at what the cops said in Virginia. Now let me ask you this. If the politicians pass a law that says that you no longer have the right to practice your religion, is it not the cop’s job to refuse to enforce that law?It is not the job of the beat cop to decide Constitutionality.
