Hello all. This seems to be the place I need! A bit about me: I’m a mid-30s family guy, and an over the road truck driver. I’m born and raised in California, but didn’t get into guns until I moved to Texas when I was 20. Cars are my real passion, and while I will admit I am, at heart, a desert rat and would make my home there, we are going to be moving to the Rochester area at some point for family reasons. While I understand some basics about the legal structure there, I’m confused enough that I don’t even completely know what to ask. Lurking a little bit here and elsewhere, it’s kind of hard to get a grasp on it. My only experience with owning firearms, as I said, has been in Texas, which is pretty close to being as libertarian as it gets as far as the law is concerned. Half the guns I have bought or sold have been in parking lots with zero paperwork involved. I’m not a super gun nut - cars take that place in my life - but I have started to think about a small C&R collection at some point, along with keeping the kinda strange little pile of guns I have already, so I might as well get on the legal side of that.

Welcome. A simple legal guide for firearms in New York:

1. If it's "fun": ILLEGAL
2. If it's efficient at doing what a gun should do: ILLEGAL
3. If you like it or want it: ILLEGAL

Wish I could convince you to move elsewhere....but then again..... the more we have like you, the better it is for us. Soon there'll be no state to "run" to in this country so make a stand.

Odds are most of the guns you've got in TX are illegal in NY.

I'm not sure what your reasoning for coming is, but most people are going the other direction for a reason.

There are lots of laws and restrictions you need to familiarize yourself with to stay legal and out of trouble. At the bare minimum you should read NYS Penal Code Article 35. That'll detail the legalities of the use of deadly physical force.

Secondly, look up the restrictions placed upon us in the NY S.A.F.E. Act.

NY is exclusively for family reasons. Since I’m not really into the most modern tacticool stuff, I don’t actually possess anything which I currently understand as prohibited, but it will still take a bit of papering to bring my stuff.

I’m mostly interested in smokeless firearms from their advent in the 1880s until basically the end of the battle rifle in the 1950s. There’s not much which puts me at odds with “SAFE” Act provisions, though I don’t quite know how they interact in some edge cases.

Article 35 sounds like it’s worth deeper reading, though.

Mostly long barreled easy stuff. Biggest mag: 10 in a Savage .22lr. The papering comes from kinda lame stuff: .38 and .22 wheelguns. Told you I’m eclectic.

Roger. I’m a bit confused by that, but I kinda sorta think I have a handle on it. I think. Hence your help. I’m grateful, but I’m afraid I’ll be more of a leech than a help :/

In general in NY, you are not allowed to even handle a pistol unless you are licensed. To get them listed on your permit you need a receipt from an FFL with serial numbers etc to before you can legally take possession/ bring them in state.

Not that you have any to be concerned about anyway.

I’ve done the run-around delay things for years...kinda works out, as the in-laws are paying a house down payment and starting papers for my wife to work as a Medicare paid caregiver for her oma. Not a bad deal.

Nothing that puts you at odds RIGHT NOW. We were fine with a lot of stuff before the SAFE act, then bang, middle of the night, better start planning on getting rid of a lot of magazines that were legal the night before.
Black powder pistol? Better not have any caps, powder, or all until you get your pistol permit, and that will be a few years before you have non-family references that have known you long enough to sign for it.

I might go after a carry license someday. That’s not my immediate concern. My parents live about half a mile away, I can stash whatever there. I’ll get my papers. No big problem there.

Rochester, yes. Not negotiable. I kinda understand the handgun thing, not really sure what it takes/means. If they’re really worried about wheelguns, they aren’t worried about me. I can stash those, no worries, at my parents’ house.

With handguns, there is a whole process you have to go through. I don't know if they make an exception for people moving here but included in the application process is the requirement to have 4 character references whom you've know for 4 or 5 years. Each county has slightly different add on requirements, but the basic application is the same state wide. The length of time it takes to get you pistol permit varies from county to county. If you do have pistols you'd like to bring into ny, you'd have to keep them either out of state with an ffl or relative, or a nys ffl that is willing to hold them until you get your permit. At which time, you'd have to have them sent to an ffl in nys to do the transfer, then you'd have to take the transfer paperwork to your county clerk permit office and have your permit amended so that it lists all the handguns. Then you'd take your amended permit and purchase coupon back to the ffl that is holding your guns and they will then give them to you.

Yup I kinda got the handgun thing. It’s weird and onerous. I also gather that if you have an FFL 03 C&R license, you still can’t process your own handguns?
