Husband files charges against Crazy soon to be ex who stole his guns and turned over to police

Courtney Taylor Irby is a Florida woman who was arrested while trying to turn her estranged husband’s guns over to police before he was released on bail following a domestic violence arrest.

Irby, 32, was arrested after she broke in to her estranged husbands home, stole his guns and brought them to the Lakeland Police Department, The Ledger reports.

Irby told police that her husband, Joseph Irby, was in "jail for trying to run her over with her car" after he followed her car after she stormed out of an active court proceeding. She claims she just gathered his guns after a judge ordered him to turn them over.

“So are you telling me that you committed an armed burglary?” a Lakeland police officer asked Irby, according to the report.

“Yes, I am, but he wasn’t going to turn them in, so I am doing it,” Irby replied.

Officers called her husband, who was being held at Polk County Jail, and he told police that he wanted to press charges.

Irby was charged grand theft of a firearm and armed burglary.

My brother-in law, on his first divorce, lost all his guns. His x sold them when he was at work for 12 hrs., he did get the children.

Sticky situation. Obviously the charges she’s facing fit exactly what she supposedly did, but were they necessary? I read an article that said he was actually ordered to turn over the guns for domestic issues and hadn’t done so. If that’s the case, I don’t see how any charges stick against her.

I lost my guns temporarily once as well, so I am sensitive to the issue but there are times when removals are warranted. This guy is in jail, so clearly there’s some issues going on.

Supposedly he was supposed to turn them in due to domestic abuse issues. The wife broke into his house because she was afraid he was not going to turn them in. I don't know whether or not there's any Merit to the story that was forcing him to turn them in in the first place.

I agree with everything except for the fact that I do think charges should be pressed against her because she had no right to go in and take them herself.

I think it could set a dangerous precedent if they don't press charges. Somebody else could steal firearms using that excuse, which could lead to greater issues.

Call the police, have them go get the guns. That is what they are there for. What she did is exactly what she should be charged for.

Irby only had to call the police to lodge her complaint. Instead she commits a felony of armed burglary. The police could have taken care of the arms since the judge ordered them to be surrendered. The husband's intent to not surrender the arms was her opinion. Even if he specifically told her so. That doesn't mean he would have failed to follow through. How many times have estranged spouses said things just to incite the other spouse just for the hell of it?

The husband could not have turned them in (after an apparent standard county judge order following a domestic charge) since he had not even been released yet ... after being held for a domestic charge when he followed and allegedly bumped her car (his lawyer claimed she backed in to him) when she fled a court divorce proceeding that was not going her way. I would also guess her lengthy history likely played in to her arrest.

If the judge ordered them to be surrendered I'd think that judge would have signed the warrant. No?

Read that posted article. If true, its pretty close to how we do it and a separate warrant would be necessary to forcibly remove them. That article lays it out almost exactly the same way it happens here.

I'm sorry, but a line must be drawn. Representation and due process must be a part of the process. I am not even agaisnt the confiscation of arms but a court proceedings with proper representation and the ability of the accused to face their accuser in that proceedings absolutely must occur FIRST. If after the accused's rights have been observed and the court deems the confiscation justified on the strength of the evidence presented then so be it.
How ever these star chamberesque "extreme risk protection order" proceedings are a a disturbing and disgusting perversion of justice.
As far as I am concerned a person is ethically justified in defending their inherent human rights with as much force as they can muster.

Our system of law depends on judges. A judge can remove almost every right you have, temporarily, permanently, in whole, in part, etc. It’s always been that way.

Due process doesn’t work the way you describe above. You’re basically demanding an immediate trial before any other step. It doesn’t work that way.

Why would they need One? The guy was in jail. I’m sure if a judge orders guns surrendered forced compliance isn’t a tough thing to attempt. Getting people to go attempt it might be another story. Utah uses no knocks 4%’of the time. Maryland uses them around 90 percent of the time. You know about obtaining warrants in one state in a big city. The number of no knocks for garbage reasons or the wrong address do show warrants are not always tough to get. It depends on the judges and location. If someone was ordered to surrender guns in the city you are telling me getting a warrant to force compliance would be tough? Define “hard to get” because I don’t think I’m on the same page here.
