Whooo. Maybe not justified. That second or third to the back of the head, tough to say he was still in danger. He is an older guy though, at least he appears so. What state is that in?

The driver kept shooting even after the threat was not there anymore. The guy shot had turned and fell forward.
It is hard to say but it seems his intention was to terminate the attacker completely.
And yes the guy who came with the club swinging was an attacker.
In NYS he would be sent to the guillotine I think.

From the footage alone I would say not justified. He could have stayed inside the car until his attacker forced his way in. A few busted windows aren't worth the headache he's about to face.

What country are they in? It is definitely not the United States. Still, I think if you did what he did here in the US, you'd be screwed and serving a long, long prison sentence.

Article says it was an iron pipe. From what I see I'd say justified. You wanna be a big man and start swinging a deadly weapon be prepared to die by one.

After he was shot once, he didn't fall down. He was still standing. He could have drawn a knife or a firearm of his own he didn't intend to use right then and there turned around and killed him. You shoot until the threat is eliminated. That's what I have learned anyway.

I believe justified. But...as we all know it will be what the jury thinks. And they can be gun haters.

The threat doesn't end the immediate second that an armed attacker lowers his/her weapon. He was momentarily distracted with no indication that he planned to cease his attack.

You could easily be dead or forever a vegetable with one good swing of bat, let alone a pipe, I say justified.
I'd say justified. Put yourself in the guy's shoes. We don't know details but looks like a road rage incident as the aggressor followed him to a parking lot. May have been following and harrassing the firearm owner. More importantly there are only about 3 seconds between first and last shot - a blink of an eye on a self defense scenario.

I'd say justified, but after reading more and more, it seems the 3rd person intervened, and the 1st attacker had his back turned or was doubled over. I'd say he was on his way down, and the guy may have fired another shot. 1st shot justified, 2nd maybe if he didn't back down after the 1st, 3rd (if there was) not justified based on the view of the camera and the 1st attacker appearing to not be a threat anymore.
We don't know if he fired a 3rd or if he was just reaching over to point or struggle w/ the 3rd person. That's where the details are murky for me, it's not said how many times the guy was actually shot. I think knowing that would help clear this up a bit.

Justified ALL DAY. The threat is not ended simply because your attacker is no longer facing you. Keep shooting til the threat stops. The shooter appears to have stopped once the guy was on the ground.

So once the drivers door window is busted out, then what? You're a sitting duck with no where to go, and you can reasonably assume that iron pipe would have been flying in. The outside of the car won't take much punishment until it's breached. By then it's too late to effectively defend yourself.

What if he was turning from the gun to run away? Lots would say if you shoot someone in the back when they're running away is a no-no.
I agree that shoot until the threat stops, so when do we determine what that is? Once he stops swinging, once he backs/turns away, or when he's on the ground?
This is why I'm not a lawyer, not the financials involved.

My opinion is he is justified , the courts may not agree , because there is a very small window where they could argue he may not have been , but in the heat of the moment its pretty hard to be perfect. I wouldn't find him liable.

So I guess the correct way to phrase the question would be, "Is he justified in New York?"
In the no right to defend yourself state we are told to run like a bitch first. I want to live just as badly as anyone else but the way the guy jumped out of his car to shoot the guy, looked like he wanted to execute him.

I think he would have been better justified shooting from inside the car till the threat was stopped. If the mad batter got into the car, he wouldn't have much swinging room. I think he was safer in the car.
Not to kill, but to stop the threat. (which he did)
Since he didn't know the threat was stopped, he kept shooting. I say justified. Really though, he should have stayed in the car and locked the doors. He saw the guy with the pipe and had plenty of time to get back in his car and lock the doors. That's just me being Monday Morning QB. This guy would be fried in NY.

If he gets off, he's still gonna get roasted in the civil suit.
If this did happen in the US, some states have laws that protect people from civil suits who act in self defense. He'd get roasted in a civil suit in NY though.
