Kel-Tec RDB-S... pinning stock at collapsed position NFA or?

It's recently come to my attention that the Kel-Tec RDB-S is 24.5 inches long with the stock collapsed and 26.1 with the stock extended.. if a NY Gun Store were to pin this stock in the collapsed position to comply with the SAFE Act does that make it an NFA item? Or does the stock still count towards OAL >26 in the eyes of the federal govt?

Barrel length not overall length.

I'm actually waiting to find an RDB-C. They come with the fixed stock already. The only thing is that they have 20 inch barrels. A cut and crown to a 16 inch barrel wil make it perfect. They also don't have the pencil barrels like the RDB-S has.

Nope, just a guy floating the idea of trying to get one of these registered in NYC... wonder if that dang police commissioner will deem it an assault-weapon

I had the chance to fondle one of these.
The ergonomics are actually pretty good.
The grip is perfectly comfortable.
