This is a great peice of advice to put in the tool box of life, other statements in this thread? Maybe not.

It's not always clear cut "duty to retreat" many examples yes but not always.

Here's an example scenario where you would have the ability to retreat but wouldn't have to.

You're pumping gas at a gas station a guy at the pump next to you steps over and pulls a knife on you and demands your wallet. You think you can safely back up and easily out run the guy because he looks out of shape, but you have your kids in the car and "retreating" now puts him alone with a knife in immediate proximity to your kids in the vehicle, you don't have to retreat.

Duty to retreat only applies when physically possible. I would say in this situation there was no duty. They were surrounded by *ARMED* protestors.

In NY his duty would have been to leave the area or retreat into the building, If the protesters didn't let him leave then you enter a new scenario. In NY you better exhaust your duty to retreat or prove you couldn't leave for XYZ. kids in the car ect. You do not have the same pass cops have. You can't pull a gun for your safety or to gain compliance.

If he was threatened in a stand his ground state then the women about to pop a blood vessel telling everyone to keep walking has half a brain. If what he did was illegal where he was I'm sure their will be a followup story about it.

I've more or less already made a conscious decision that if I ever think I have to draw it's because I plan on shooting. I don't want to put myself in a position where I draw hoping to change someone's behavior, then pause and hesitate potentially then putting myself in a bad position of being disarmed or confronted. IMO It's also a harder case to defend if you draw, wait, stand around and then have to shoot to defend yourself. Then the question becomes why didn't you back up during that time?

Agreed. Once you clear the cover garment they have about a second to make it very clear that the situation has changed drastically.

The reality is that changes significantly even within NY.

One county, any reasonable defensive use is likely to be OK. Another might consider any attempt to defend yourself a prosecutable offense, no matter how bad the situation was.
