Kinda funny, then again not so funny

This happened to a buddy of mine, yesterday.

He went to the Wal-Mart in Watertown to get groceries for the weekend. he left his THREE DOGS in the car with the windows rolled down, outdoor ambient was 74° and mostly cloudy, some sun.

he was in there about 15 minutes. When he came out to his car there was a little old lady and a State Trooper next to his car. He KNEW exactly what was happening. "Church lady" called the cops because his three dogs "were panting in the back of the car"

apparently "church lady," said something to the fact that he "was purposely killing his dogs" which of course set my buddy off and he told church lady to mind your own business. Which put the trooper on alert at which point Mr trooper asked if he had any firearms. Which of course my buddy was carrying his Glock 10mm at his 4:00. When he said "yes ( he was pointing to it) it's right here" the Trooper freaked out and yelled "don't reach for it, DO NOT REACH FOR IT, my buddy has his hands up at this point. Mr Freaked out trooper slams him up against the car ( assume the position) and disarms him, pulls the mag and clears the gun. Mr Freakedout Trooper inquires as to whether there are any more firearms in the vehicle. My buddy response was, sure, in the duffle bag. Now Mr Freakedout trooper goes a little nuts and starts yelling at him about having two guns and now he calls for back up?

all this time the dogs are still in the car.....

apparently, the New trooper is a little calmer and explains their system actually sucks and they have to call the sheriffs office in the county he lives in to confirm his Pistol Permit is Legit. and to confirm his serial numbers blah, blah, blah an hour later, the dogs are still in the car PANTING, everything is confirmed and he's allowed to leave with his dogs and firearms.

He was pretty much laughing at the whole mess. But this is an example of how confusing the state police are about the law. this started over some dipshit SJW thinking she was saving dogs and it ended up with a NYS serf being harassed for no reason

Being bad at your job should never be a death sentence for anyone. No shit.

HOWEVER, 1 job in the US allows you to kill other innocent citizens and have people DEFEND YOU! Being a cop is that job.

If you "make a mistake" and draw your gun because "I'M GOING HOME TO MY FAMILY AT NIGHT! ", the majority of people support you and tell detractors to not Monday Morning QB. How about this, asshole?: "If I let you. The statement should have been "WE are both going home..."

My feeling is on the flipside, if you, as a cop, draw a gun on someone that doesn't deserve it (and I mean IMMINENT LETHEL THREAT), you should INSTANTLY lose your job, no questions asked, and most likely face jail time.


Harsh? Sure. But that's what would happen to any other citizen. Yet cops seem to have some absurd "aura" over them that makes this shit ok.

Don't give me that "dangerous job" crap. Don't give me that "and people complain about them all the time" crap. Happens in tons of professions.

The uniform makes you NO different from me bud. And when the random dude gets shot on the street corner in Chicago, you go "meh, shit happens."

My buddy did say the second trooper that showed up, "the back up" was pretty cool about the whole situation and Mr. Freakedout Cop did calm down after Mr. Cool showed up.

The funny part was the amount of time the dogs spent in the "hot car" the entire time this freaked out cop was doing his background checks. This entire encounter took over an hour? As soon as he said he had a gun, the dogs were no longer a concern, at all.

If the cop was doing his job correctly, the entire encounter should have taken all of 5 minutes

From my own related experience, I think all handgun owners need to be acutely aware of these types of situations; how they can go down; and how to behave during them so as to come out unscathed.

Seems like the best thing to do is to: REMAIN ABSOLUTELY CALM; say as little as possible; and to know the law and your rights with total certainty.

I know when two cops showed up at my home over a domestic 911 call made by a man who had threatened me, that it was VERY UNNERVING when the cop got right up in my face, forcefully giving me shit over carrying a firearm (on my own property, and 100% legally to boot); ordering me to let him disarm me, and then hitting me with a barrage of intimidating questions as to why I was carrying, etc. Sort of similar to the drill sergeant scenes in Full Metal Jacket, except that the cop really can fuck up your life in a major way if it goes south.

All my information is right here on my permit which I'm required by law to have on my person, you can see and record that info right there and if you need follow up my address is on the permit. If you are going to prevent me from leaving, you'll have to arrest me, but I would also let you know you will have to show cause to the judge and my attorney will bring attention to the fact that you're violating my rights by rendering an arrest for the purpose of verifying information on a non-criminal complaint.

Now the Trooper can ignore you, laugh and have a fun day of it, but I wouldn't submit to sitting around while he checks me out which is absolutely nothing but bullshitted because there was no cause to ask about firearms at all. And if you refused to answer? There again is no law requiring declaration, and as demonstrated here, you now have the ability to refuse to answer for fear of unacceptable reprisals...

Leaving animals in a car is not a crime, or how will the Canine Units explain their cages in the back of their service vehicles? Hmmmmm...
By the way, was the lady reprimanded for filing the BS report?

Right, I guess that when you are in fact searched with or without permission by the officer, hope that when you were found to be lying that it gets thrown out in court because it was an illegal search, or hope that when it's a legal search due to suspicion/probable cause that you lying to the officer doesn't get you physically fucked up in some way and get you charges and more time in jail and additional court fees to fight.

And how can you tell for certain if you will end up being or not being searched? lying will certainly work against you 100% of the time. Better option would be to not say anything at all.

I agree with you. But for the record, at least with the New York State police, the canine units all have redundant systems that keep the truck running and air-conditioned at all times.

That's simple. "Sir, please step out of the vehicle.". If on foot... "Sir. Keep your hands where I can see them and don't move, face away from me, up against the wall or car, ECT.".

Whether they have probable cause or not, lying is not a crime and at the end, you did inform him.

I can almost guarantee the dogs temps would be higher than normal. A dogs temp should be 100-102.
At 106 for extended time, it can be dangerous.
Ill bet the dogs would be at 106 or better for a short time in the car. Its not a big deal, dogs can handle heat better than cold usually.
The point is, if you prove the dogs were overheated by the cops delaying you, the cop would need to prove the dogs were heated before the delay, which he cant do.
Just saying, throw that up on facebook and the cops would hear about it, facebookers freak out about animals.

I hate seeing dogs in cars on hot days.
Ive seen what can happen when dogs are left too long.
Its a very painful death.
Much more painful than dying of the cold.
In the cold a dog becomes hypothermic, their brain forces them to "sleep" then they die.
Heat makes them hyperthermic, which causes organs to fail one at a time, usually the brain is last....very painful.
