That's simple. "Sir, please step out of the vehicle.". If on foot... "Sir. Keep your hands where I can see them and don't move, face away from me, up against the wall or car, ECT.".

Whether they have probable cause or not, lying is not a crime and at the end, you did inform him.

Someone correct me if I'm wrong, but it is my understanding that (in NY anyway) there is no requirement to inform a LEO that you are carrying concealed, - unless asked when you have been legally stopped. Obviously, we have the right to remain silent and say nothing while exercising our 5th Amendment right, - and we then need to remain silent, or courts have ruled that we have then waived our 5th Amendment right. But, I think they can legally jam us up if we lie to them and say we are not armed when in fact we are.

I don't like some of the crap we endure anymore than most others on this forum. And I really don't like the BS "safety checks" I have encountered while riding my motorcycle. The next time I get stopped by one, I am going to refuse to pull off road for it and be searched, and then remain silent other than to ask if I am being detained or am I free to go. I am sure I will be encountering one on Friday October 13th at 7AM at the Peace Bridge when I am entering the bridge to go to Canada. Every Friday the 13th they harass bikers headed into Canada as the Port Dover, CA biker festival is that day.

What exactly did he say when he told the church lady to mind her own business and how did he say it? I don't see how/why a cop would immediately ask if your friend had any firearms if he simply told the lady to mind her own business. Was he getting agitated, yelling or cursing? I don't see how/why a cop would immediately ask if your friend had any firearms if he simply told the lady to mind her own business. Was he getting agitated, yelling or cursing? (He certainly had a right to be angry). What made the cop even think about guns? Why would a call about dogs in a car even bring this subject up?

He didn't elaborate on what exactly was said. Knowing him, it was NOT a polite conversation. Im, sure he used colorful language and more than likely told her off. He's had dogs for 20 years or more, he hunts his dogs (as do I), He was on his way to camp (he's my neighbor ~~ a ¼ mile away) and just stopped for some dinner and breakfast groceries. Im 100% positive he was in Wally world for less than 10 minutes.

My guess would be his colorful language combined with anger probably alerted the cop.

If they deem "extreme weather" for dogs to be 74°, then a whole bunch of us hunters are going to arrested. I leave my pup in the car for short periods when it's 20° or when it's 80°, but generally, if I know it will be more than 10 minutes, I'll leave him home or me or the wife will remain in the car with him.

Jmac, I was only posting up the law; not an excuse for the behavior of the officer. Actually, the Trooper sounds like a complete Douce bag! I have zero issue with the Trooper responding to a radio call. One of his jobs is to investigate possible crimes. He should have arrived on scene, noticed that the temperature was not very high, told the women that all was well. He should have told your friend he has good taste in dogs, gotten back into his car and he should have drove away.

well, not really. This was on his way to camp, he lives in Scottsville. He stopped at the Watertown Wal-Mart to get groceries for Saturday night and Sunday Morning. The only reason he was coming up to camp was to change out his Inverter. He smoked the last one some how.

As Jmac mentioned it was his friend's behavior that caused the cop to ask. Ordinarily it wouldn't even come up but my guess is along with the colorful language there must have been some phrase that made the cop curious to see if he was carrying. The lady should have minded her own business and Jmac's friend was justified in being angry. But I sense the escalation was due to his behavior. A calmer response would have been in his best interest.
