The man who fired the first shots from behind Kyle Rittenhouse during the fatal incident in Kenosha has been charged.
Joshua Ziminski, 35, has been charged with disorderly conduct and use of a dangerous weapon for firing his weapon during the incident on August 25.

In another video, the defendant and Kelly are seen walking near a fire in the area of the Ultimate Gas Station lot. In later video, the defendant’s right arm is seen on the video, which is taken near 63rd Street and Sheridan Road, in the City and County of Kenosha, State of Wisconsin. Detective Howard reports the defendant’s arm pointing the gun upward towards the sky,” the document explains. “Detective Howard observed a muzzle flash emit from the handgun, and heard a gunshot at the same time. In another video, the defendant is clearly seen at that same location. The defendant is seen walking in the same area, holding his right arm upwards, and firing off one shot from his handgun. The defendant and his wife are then seen leaving the area. Several other people are in the nearby vicinity when the defendant fires the handgun.”



The police go on to report that when speaking to Ziminski, and his wife who was present at the time, both admitted that he had fired off a “warning shot” into the air.

This strengthens the case that Rittenhouse had reason to fear for his life and was acting in self defense when he shot and killed two rioters.

But if you *do* have some legitimate reason to use a firearm as a signaling device instead of a weapon, fire into the ground not the air.

You are responsible for knowing where that bullet will end up. You have no idea in the air. You know *exactly* where if you use the ground.

OK not nit picking but more of a public service announcement. The safest direction to fire a gun is ever changing. Generally shooting down into dirt is safe. A hard surface like concrete or black top is considered a bad idea because of potential for ricochet. A strait into the air shot has its risks but It would take a very large bullet to cause death once the bullet lost all its velocity. Once it hit terminal velocity it would depend on a decent amount of factors to be lethal. I'm sure the math has been done on it by someone. Confident a standard hand gun caliber isn't going to kill anyone on its return to earth,

they dropped the gun charge in Ill , which will strengthen his self defense case in that he didnt take a weapon with him or plan to shoot anyone.

I cant see him of ever being convicted on any count. the DA in Wisconsin must be pulling his hair out trying to get a plea deal

Its not nit-picking, its exactly right. Firing a shot into the ground has a great chance of ricocheting up and into an unintended target. Even if you're on the grass. 4" of soil over bedrock can allow a ricochet up up and away.

Ricochet risk is strongly dependent on angle of incidence.

Concrete could be an issue. Asphalt probably not if the angle is very steep.

Not *too* many places where it’s all concrete and you can't just choose another point. Maybe inside a big box store ?

I can't imagine the scenario someplace like that where you would want to discharge your firearm anywhere other than an attacker, but assuming you found one, I would think you could choose a line of fire that would put any ricochet into the bottom shelf of whatever product happened to be nearby.

Penetration is going to be non-existant after a round has bounced off concrete at 45 degrees.

Well, even fired at a shallow angle it's not going muzzle velocity 1000 yards later.

But, while a round fired at 45 degrees isn’t going to come down fast enough that we would be happy with it as a defensive round, the criteria for it being "dangerous" is much much lower.

People do get killed this way, so just don’t do it.

I still stand by my earlier statement that the ground is safer. Unless you *know* where the bullet will end up, then you don’t know if it's safe.

I will clarify that last sentence though, you don’t have to be specific, we frequently target shoot where the "know where it will end up" could cover a couple acres of a hay field. But we know it will end up in *that* field.

Since we are moving to AZ in a few months I have been familiarizing myself with the ins and outs of their gun laws.

The following was passed as a direct response to an incident that directly relates to this discussion.

The short version is that a kid got killed by a guy shooting in the air in '99. Parents found out it was at most a misdemeanor even though she died and raised hell. It is now a felony there to discharge a firearm into the air.

It's bullshit they dropped the charges but that shouldn't matter for Kyle's defense. He was being chased by a group of people and someone fired a shot while he was running away. Even if he had no idea the shot was into the air he feared for his life AND a witness says the child molester tried to take his gun.
