I'm with you as I believe the 1st and 2nd Amendments are pretty damned clear, but the record of court cases isn't. Simply put, why do you think it is perfectly "constitutional" to require permits for certain protests?
I've been arguing this issue with my friend (the one in the video) for weeks now. He's shown me court cases - some which go far back - that support the state and local government levels having the ability to limit protest activity for specific reasons.
I don't support it, and again, I left Manhattan partly because of this crap, but the law actually does support stuff like what you see in this video to some extent.
Last week my union sent out a long explanation from our lawyers that basically summed it up as "murky". Based on that, my union suggested refusing to take action unless directly ordered by a superior and then fully documenting who gave the orders. That's why in this video, even for a small protest there's some heavy brass present.

I am sure the cops in China rounding up Muslims and sending them to actual concentration camps right now have memos describing why it's perfectly legal.
If you ever get orders to do something you know is wrong, you will probably also have a memo explaining why it isn't. If you follow those orders you will still be morally responsible, no amount of "doing my job", "the brass ordered it", or "the courts upheld it" will change that.

Abandoning your personal belief in the legitimately of "the system" is no easy thing, even more so for those of you who's whole career has revolved around enforcing it.
I think the greatest indictment though is the unaccountability of the "elite".

I don't think I need to regale anyone on this board with a litany of similar examples of the powerful getting off for crimes that would send anyone else to prison for decades.
So, once you decide that "the system" is horribly broken and beyond repair, you have to ask "how can we do any better".
The answer to that last one is where most people screw up. The answer is "we probably can't".
I look at who would actually be in charge of the side that wins a Civil War in the US, and I don't think I would like the government they create any better than the mess we've got.

Dropping our banana republic on it's ass, kicking it to the curb and actually applying our current laws equally to EVERYONE would go most of the way to "keeping the republic"
Ditching 1000's of state & federal rules, regs, requirements and other entrapments would get us that much closer.
