That atf is from 1998 and result of the method adopted during the federal ban.
The ny ban prior to ny safe doesnt mention anything about welds.
This cannot be challenged because they will loose the argument as all customers have to do is to pull out the sales receipt from the firearm that was legally sold at ny stores with the muzzle just pinned. These passed inspection by the ATF when they do recounts and inventory. Not only that we have NYSP answers on video recorded. So they cannot forbid something that was already approved and sold.

How many times we have to explain this as it was explained by actual FFLs in these very same forums.

The same people who actually sold them legaly, did the inspections with the ATF and had NYS local PD and sheriff folks both on and off duty buying those rifles and ammo and whatever else.

Sadly most FFLs here abandoned ship perhaps due to this endless horse beating nonsense. Some others sadly passed already.

@Eddie Gunks when you had the FFL did you get inventory of any of those stag and RRA, etc that had the brake just pinned?
They had them at gander, beikirchs, etc.. terry had a couple too.

Perhaps we hear from some other current or past FFLs who know how this actualy works.

How many times did a law enforcement agency instruct a FFL to recall a product due to legalities that were sold previously ? Just recently it happened to Franklyn Armory with the ATF. Previously it happened with the bullet button equipped rifles here in NY.

It all depends on the law enforcement agency and what their priorities are.

The actual text of the law isn't important.

What matters is what a potential arresting officer *thinks* it means, and what your lawyer can convince a jury it means.

We've all experienced terrible legal advice from the LGS, imagine how many ill informed officers are running around out there with all sorts of wacky ideas about what's legal.

I agree the text of the law is not as important as something that has been done countless times and already accepted by all parties involved and becomes a consuetudinary law something not unusual around imprecise, contradicting or arbitrary laws and ordinances.
Nobody is recalling anything because it has been already approved, discussed and the horse beaten to death all over.
It is not the LGS alone, it is the Manufacturer(invoice to NY), the ATF(inspection already approved) and the LGS(invoice to Customer), State (Taxes collected) and Customer, but, in this case, it is also Mike Green and Mr. Hogan (NYSP) who are on record and on video.
Scope and other organizations have all the information on record. The ones who were there we also have it.
Can someone arrest someone? sure, I guess this could be for anything. Do they have anything valid for a DA to follow through? No.
One probably doesn't even need a lawyer to have the arrest tossed into the trash.
It has never been questioned, it has never been part of the argument of any arrests, it is such stupid thing that it has never been brought up by anyone other than the forums for horse beating purposes.

So after I have spent, probably thousands, at 'Optics Planet' they sent me an email telling me my latest order will not be shipped unless I remove the KAK flash can. I emailed them back and asked them to cite what law or regulation exists that would prohibit my receiving this particular product that they offer in their sales inventory. I'm waiting to hear , but not holding my breath.
If they do indeed withhold that part I will send them another email explaining why I am severing all ties with them.

They should just reply that "We are aware that there is no law that would prevent you from owning this at the address you have requested us to ship it to.

However we are also concerned that this will not stop the NYS AG from suing us for shipping it. We are not willing to take that risk, and are consequently declining to ship
products like this to NY addresses."

At least that would give you evidence that could be used in a lawsuit against NY were you so inclined.

Stay away from them. They are a warehouse with a website and give zero fucks if you have any problems.
Not as bad as cheaper than dirt but with the same type of philosophy of screwing customers.

sorry for the late reply. No i did not. Only cause i never/(seldom for the pedantic people. I cant remember....ha ha ha) bought “compliant” firearms from other manufacturers.

The source are the rifles sold in NYS when the law required them to be permanent. Delton, dpms, and a few others sent the rifles to stores and ffls screwed and pinned. Nothing else. The same was done later with thread protectors to cancel threads.
Those were sold and some might be still in stock.
As of today not sure any manufacturers would be interested in selling firearms in nys but those already sold or on the shelves are not less permanent than before.
These are facts no my opinion.
Ask ffls who sold them.

So my apologies, but to clarity, the thread cap is pinned, but not welded? Did they peen the pin in or simply drill slightly undersized?

The ones I saw from factory had a hardened pin right in the middle catching the threads. I cannot tell you if any had epoxy in the threads by I doubt it.
Effectively is irreversible wo machining and or tools.

Is welding the issue? If going through the trouble of drilling and pinning then you could just buy a cheap MAPP gas torch and some silver solder. Doesn't take a ton of heat and it will go nowhere. It's super strong and will only need the tinniest piece cut from the spool. stay-brite #8 is fanstastic.

A weld on top of a pin doesnt do anything at all unless one has a larger hole and loose pin bubba style. On the join yes but on the pin can be drilled as easy as wo the weld.
The weld might even make it easier to drill out.

question .. does it really matter .. remember that couple that were lawyers defending there home a few yrs ago ..

they took her non working pistol to the lab and made it work again to lay charges ..

so they take your pin and welded AR to the lab and remove it .. see your honor .. it has threads on the barrel ..
