The gun had a malfunction due to an imperfect part. Anyway, why are we arguing this? It's semantics on words. What we should be focusing on is the ridiculousness of people carrying empty guns.

as i have said before i hate that word ... negligent ... there is a line between it and Accident .. negligent i think is used way to much ..

you driving down the interstate and your tire blows out and you crash your car / truck .. or if your driving a tractor trailer and your steer tire blows and

Heisenberg uncertainty principle. It proves that there is no such thing as zero tolerance. It doesn't exist. You basically can't be 100% sure of anything no matter how hard you try. Accidents... happen.

A certain % of any process will fail. You make 10 million guns, even with due levels of care some lemons will slip through.

Neglegence is not using appropriate levels of care, it is not being not perfect.

If your process produces 9,999,999 good guns in a row, that is evidence that it works. if #10,000,000 is a lemon you have still exercised due care.


What about the guy who has a stroke/seizure and that causes an accident ? Where is the negnigence there ?

This is what I tried to explain. That things sometimes happen that are purely accidental but whatever. Can we all at least agree that it's a good thing the dude didn't shoot himself in the heel with a .45 or he would be dead?
