Nevada judge stands by her dismissal of Cliven Bundy standoff case
A federal judge in Nevada on Tuesday rejected prosecutors' request to reconsider her dismissal of the conspiracy case against Cliven Bundy, his two sons and Ryan Payne stemming from their 2014 armed standoff with federal agents over cattle grazing near Bunkerville.

U.S. District Judge Gloria M. Navarro found prosecutors raised arguments she had already considered. She dismissed their contention that the dismissal of the case with prejudice was "unjust,'' or that she should have ordered a less severe sanction for their failure to share evidence that could assist the defense as required by the 1963 landmark U.S. Supreme Court ruling in Brady v. Maryland.

"The Court's finding of outrageous government conduct was not in error,'' Navarro wrote in her 11-page ruling. "On the contrary, a universal sense of justice was violated by the Government's failure to provide evidence that is potentially exculpatory.''

The judge said she had considered alternative sanctions, such as a potential retrial or lesser penalties.

"However, the Court found that no lesser sanction would adequately deter future investigatory and prosecutorial misconduct,'' Navarro wrote.

The judge also said she concluded the indictment could not survive as a result of the government's violations, and did consider the potential ramifications that could result from the dismissal.

A Federal Judge with balls... Gotta love her! Bout time someone simply illustrates that the ends, do not always justify the means!

And all this, all that is failed to be discussed is the escalation of powers introduced by the Barack Hussein Obama administration to every single acronym agency while he was in office! From the EPA to the IRS, FBI included, the abuse of power was significant and ostentatious! He armed the Dept. of Agriculture for heavens sake... Without the need to explain why, and the Dem's in power didn't ask either. The Bundy ranch scenario scared the shit out of the Feds because of the armed (non-violent) response and local citizen support vs the Big Bad Gov't. At the simplest levels, the Gov't had recourse to use to effectuate the payment of fees and fines for non-payment as they would with any business. They chose otherwise... They chose to make an example, to show off their powers with intent to seize property (cattle) through force and knowingly escalated the encounter at every step. They hated the fact that Drones exposed them and is a large reason for the tightening of control after that event of public use and registration of drones. There's dozens of wrong moves by these idiots and I'm glad the Judge could see that to resurrect their case would only serve to endorse their errant actions and promote repeated occurance.
