She didn't say that because she believed it.Well hochul was wrong again as she said this type of stuff doesn’t happen and CCW never help people out.
Second the legal team needs to reach out to this guy to add him to the lawsuit to firm up standing. This guy certainly has standing since it’s on record he broke the CCIA rules/law and is now a felon.
Having a gun (lawful or un lawful ) in a place that serves drinks in many cases have been on the books for decades depending upon the area involved. Some one weigh in but often it is a percentage of revenue Bar vs food determines this. Could charge him under a law that has been on the books for decades avoiding a court challenge to what has been just introduced ?heil hochul won't press for this man's arrest. I doubt she'll even mention this and, when questioned, will just blow it off or say something like "I'll have to get back to you on that".
She would know that arresting this man would seriously risk her pride-and-joy legislation getting overturned in court, and any attempt to demonize this man would backfire even more than her decision to have ugly eyebrows painted on her forehead.
NY never had any such law as far as I know. Check out the recent district court decision. There is a well reasoned and thorough explanation about this. To boil it down for you, there is simply no history and tradition of guns being banned in places that sell alcohol. They were able to find where territories banned it in a few cases but they were not states at that time so they don’t really count and the court said that a few places banning guns is not the same as a national historical tradition of it. The Supreme Court has spoken and if it wasn’t a historical tradition in 1791 or some time in 1800 then it doesn’t pass the test and doesn’t fly.Having a gun (lawful or un lawful ) in a place that serves drinks in many cases have been on the books for decades depending upon the area involved. He will probably be sued by the perp for making him feel unsafeNo good deed goes unpunished, so they say. It'll be interesting to see the outcome, if there is an outcome published. If the good guy with the gun isn't punished in some way, the lib press might simply sweep the story under the rug. That way the good guy and his gun won't look good at all.
I read the comments and was shocked by one detail. Evidently some of the commentators were actually witnessed and were there. Some asshole was actually yelling at the guy who pulled a gun and demanding he furnish his permit before police arrived. These are the dickheads out there. If you have Facebook you should see the the comments. Lots of first hand comments
I believe the asshat yelling is a volunteer fire fighter too.I read the comments and was shocked by one detail. Evidently some of the commentators were actually witnessed and were there. That sort of law is common in many places. It is not very common in NY.Having a gun (lawful or un lawful ) in a place that serves drinks in many cases have been on the books for decades depending upon the area involved. How in the holy hell would the average Joe have any idea the revenue breakdown of a local restaurant to know if it's legal to carry in there? I've never heard of such a law.Having a gun (lawful or un lawful ) in a place that serves drinks in many cases have been on the books for decades depending upon the area involved. this would have been a great time to give the knife back to the perp and let the fireman take his chances.I believe the asshat yelling is a volunteer fire fighter too.
If someone in Texas sued they’d win as that law does not meet the bar set in Bruen. It has to be a widely accepted law on the books in 1791 or similar. Just because it’s been the law in Texas for 20,40,65 years in Texas doesn’t make it a historical tradition in the nation.Texas, but it has to be posted on a sign:
