my phone is encrypted.. hell most newer android devices can enable encryption..
Solution is simple.. Just turn off or restart the phone.. It comes up to the encryption key screen.. then just willingly turn your phone over to them.. They cant bypass the encryption to unlock the phone, and they cant compel you to give them the key.. by law you just complied by allowing them to examine your phone, and they wont be able to get a damn thing off of it..

Disable what? The OP means the police for phone sucking system and they get all your information inside it Driving is a privilege and there are no rights that infringe on safety. Hand the freaking phone over in any crash and prepare for jail.
Only excuse, is the person that jammed their up their ass before they went driving. They had the right idea.

Correct. Driving is a privilege. Unreasonable search and seizure is a right however that is protected by the Constitution.
Answer what happens in the other scenarios above. IE passenger using your phone, pulling over to use your phone, bluetooth, ect.

So you want GPS to disable a phones ability to text and email... What about passengers why should they be unable to use thier phone.. what about people taking a taxi or a bus?

I am against texting/using phones while driving. I realize it's dangerous.
At the same time, holy crap this is an invitation to wrongful convictions, infrignement of our 4th ammendment and way too much abuse of power.
I hate this idea.
If you want to prove someone was texting while driving subpoena their cell providers records to determine if at that time and location the phone was sending data. If not then beat it. That is evidence based and due process. This stupid by system would be a joke. So I guess actually that means we should expect it,

I got rear-ended a couple years ago and the guy said he was switching the station on the radio. Officer said, "Oh, so you were distracted then?". Just like that, he's part of this statistic and it had nothing to do with cell phone use.
Bullshit numbers, being used to push unconstitutional intrusion into our privacy. Same shit, different day; remember how suicides usually get lumped into "gun deaths"? Shame on those of you who would sacrifice the privacy rights of all for the misdeeds of a few. Have we, as gun owners, learned nothing?!? They persecuted us and sacrificed our rights upon the alter of Safety and, just as in this case, they spun, twisted and padded the "facts" to do it.
The road to hell is paved with good intentions... and assholes on cell phones, but there has to be a better solution to this problem.
