Fine agreed about the texting. However what's mine is mine and if I don't want what is mine touched then it will not be touched. my phone is encrypted.. hell most newer android devices can enable encryption..
Solution is simple.. Just turn off or restart the phone.. It comes up to the encryption key screen.. then just willingly turn your phone over to them.. They cant bypass the encryption to unlock the phone, and they cant compel you to give them the key.. by law you just complied by allowing them to examine your phone, and they wont be able to get a damn thing off of it..
You will think different when the texting driver hits you and you have permanent injuries such as brain damage and paralysis. Not fun.

First of all I hit my head and forgot my phone password.
Second, I can text in my car without ever touching my phone as well as search and play music over the Bluetooth connection. What proof would the authorities have that you were actually touching the phone at the time of an accident?
What about "probable cause" before a search?
