NY Legal AR with features?

So after doing some window shopping on Gunbroker, I stumbled across this ad for the gun on the top.

Apparently it is legal because it is not classified as a rifle or pistol, as it has a pistol brace, which make it NOT a rifle, but has a fore grip, which makes it NOT a pistol since the legal definition of a pistol is a gun designed to be shot with one hand. Now, I’m not willing to be the test case for this, however upon further research, it seems that people in CT have used this loophole and stores there and some in NY have begun to sell some of these. To my understanding, NY SAFE doesn’t mention AOW (although I believe they’re referred to as “other”), which is why guns like the Mossberg Shockwave are legal in the state. So would this gun be legal to own? I’m very confused, but the thought of owning one of these is kinda making my mouth water, it looks so nice.

Do you think a cop won't classify it as a pistol with a pistol grip? You can not call it a pistol and the cop and district attorney can call it a pistol. On the same token, in the courtroom next to you a guy can be on trial and can have the same exact gun and it was a pistol with a pistol grip, shroud, magazine outside of grip, over 50 ounces, ect.

(v) a threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip, or silencer;
(vi) a shroud that is attached to, or partially or completely encircles, the barrel and that permits the shooter to hold the firearm with the non-trigger hand without being burned;
(vii) a manufactured weight of fifty ounces or more when the pistol is unloaded;

@LethalTurtle I'd get a very good pro 2A attorney on retainer before you took possession of such a thing. Even if this item is legal I guarantee the local cops and the Statie Storm Troopers will arrest you if they see you with it.
You are probably good with the Sherriffs though.

Correct. Lawyers are good after the arrest. But unfortunately, even then they can't argue correctly since they aren't gun experts (as evidenced even with NRA lawyers in high profile gun cases) and they will still get paid by you while you are behind bars or if you managed to pay your 15,000 dollar bail.

There should be an expansion of these CCW insurance programs to cover this sort of thing.

Right. They are taking a chance. Let's say they build this so called "Firearm" legally as per the law.

Now let's say I build an AR pistol illegally and add a pistol grip to it.

We are both in the same car and get pulled over. I'm pretty sure we'll both get charged for an illegal AR pistol since it's the same gun. They aren't going to say that one is a pistol and the other one is a firearm when it's 100 percent identical.

These have been selling in this state since Shot Show 2018. They are nothing new. Now there are several manufacturers that make them. Some more expensive than others. I see them for $1299.00 locally.

In court the DA is going to explain to the jury the legal definition of an “assault weapon”. He’s pretty much going to describe that weapon to a T. You have to be willing to trust that your lawyer can convince a jury of people who aren’t gun experts why it isn’t one. Only you can decide how confident you are in that happening. It’ll cost you big $ no matter how it comes out.

At this point I don't think we can do anything. Think all the legal options have been tried and we have been abandoned by the groups that we donate to fight for us. All that seems left is for people to get arrested and be willing to not plea out and take on the battle which will cost a crap load of money or just accept NY is lost and move.

Idk, I feel like there should be more done outside of the legal realm. Unfortunately most republicans have jobs and can’t spend the day at a march like the liberals do, but there’s gotta be more

But there was protesting when the safe act dropped. A few of them. I know my local gun club rented several buses more than once. Us gun owners are sub human to coumo and most most NY politicians. They don't care and the big voting base NYC doesn't care. Sucks but is what It is

You are right, of course. That said, the law we are currently stuck with is all about cosmetics, not functionality, so that’s the game we have to play. Unless we can get SCOTUS to assert themselves, the Safe act is going nowhere. I’m not hopeful for help with Roberts in charge. He seems allergic to making the tough calls.

Yeah, just not sure how it's going to play out. My brothers works with some guys from PA that said things are not much better right now and now they are pushing for a safe act of their own. Others says its just Pittsburgh starting crap and it won't hold up so idk .going to wait it out.

Yes a few shops openly sell them in NY (putting their dealer lisence on the line imo), I've seen a few people shoot them at the range, AFAIK nobody in NY has been arrested yet for possessing an "other". I wouldn't risk it though, I thought of buying one but I think they're way overpriced. Remember not too long ago an overzealous DA targeted numerous gun stores in Nassau County for selling AR15's with a "pinned" stock (under the old AWB rule). Guess what nobody was convicted and all charges were dropped, that cunt is now a member of congress.

Technically legal the way the law is written. I wouldn't buy one unless you had money to throw at a lawyer and the courts. As has been stated- the cops are not going to argue with you weather it's legal or not, they will leave that up to the courts.
