I dont know her motive, but its not a test case, and she didnt get any preferential treatment. She's a republican in NYC, if they had anything on her they would surely crucify her.
There is nothing in NYS law that says an inoperable firearm is not a firearm. If there's something I'm missing, I'd love to know. But I haven't been able to find it

First, that wasnt NY. Second, she was pointing it at people in a threatening manner, that makes out menacing at least in NY. If an imitation pistol is used in the commission of a crime it is considered real gun.

A pistol in ny that is not illegal would have to somehow be rendered completely incapable of being restored to use. Most of your comments on this are just drivel about how she did nothing illegal. I've seen thousands of "joe schmo's" afforded the same. Its not a luxury, its a fact of law. And most, if not all of them were criminals and had other charges along with the gun and couldnt even spell 2A. Have you ever fired a gun with the recoil assembly removed? And I'm still standing by the fact that is very likely the reporter misquoted something. I also doubt the projectile will even reach the muzzle if fired without the spring. The explosion is going to focus in the direction of least resistance, in this case, back towards the shooters face. But I have never done it and wouldnt try it for any money since I'm not partial to taking a slide to the face.
It doesnt? Why did the DA say the case was being dismissed because the gun was inoperable? It means everything. When I was working, a DA adm aide would come in before the court was open. Hand us any lab reports, ballistic reports etc related to open cases. Every single day. We would read them and any labs that said "no controlled substance found" or "Firearm inoperable" they would get attached to the case papers and put on the side. At some point the judge would stamp them "case dismissed" and sign it without even reading the papers. Imagine that, for 30 yrs we were doing it wrong, and all I had to do was check in with some Slacker and get it right.

It’s not preferential treatment at all. She’s a conservative Jew and the democrats in NYC hate those that she is. The reason it was dropped is they can not prove the firearm was operational at the time she was carrying it so therefore she didn’t commit a crime in the eyes of the law. That whole innocent until proven guilty thing gets in the way again.
