Then you are meeting up with people that had issues before smoking weed. What you just stated makes no sense. I know some seriously smart people in high positions that smoke weed everyday. I know quite a few and you would be quite surprised if you knew who they were.

I don't have a problem with people using whatever they want, but no good is going to come from restricting employers ability to ensure their employees aren't chemically impaired on the worksite.

There's no pre employment testing for alcohol. Why should there be for cannabis?

You show up for work drunk or tipsy and you're sent home for the day, or for good.
You show up stoned you're sent home for the day, or for good.

NYS is an at will employment state, meaning you can be terminated for just about anything.

Alcohol is legal. Now cannabis is legal. That doesn't mean consumption of either before or during work hours are permissible.

You guys who support the drug testing are not thinking this through rationally. Not testing for hiring reasons doesn't translate into permission to work while stoned.

The difference is cannabis residuals will stay in your system for 30 days after your last use. If someone is a totally responsible consumer of cannabis, just like a responsible alcohol drinker, they'd never be hired because of the residual in their system. An alcoholic could be hired without ever knowing you just hired an abuser.

Given that it is now a legal substance in NY, it makes perfect sense that employers can't test for it as a condition of employment. If you drink the occasional alcoholic beverage you can't be opposed to this.

I feel tou, but that may be part of the exemption on where you can test people. It’s not an outright ban, but you must show a need.
I work for the state and I was hired some time ago, but I was floored they didn’t drug test me. Finger printed and that was it.

I’m not so sure that alcohol is worse than weed. There are lots of problem cropping up with weed use. There is a THC related illness in heavy user that is causing lots of er visits, mental health issues are cropping up, lack of motivation and many things. We will learn more and I’m fairly sure it will be proven not so good for you.

Just because people smoke weed doesn’t make them stupid. A lot depends on what type and how often they are using it now. Keep in mind the weed of today is many times stronger than the weed of yesterday. Also wait until big business gets involved and changes it to be addictive like they did cigarettes.
edibles are so new we have no history, but many don’t understand how they work and it leading to issues. Many “over dose” on edibles because of how they work. Many think you can’t overdose on weed, but you can’t. It’s not fatal, but could lead to deaths especially the more widely it becomes used.

But let’s not confuse the point of the post. It wasn’t to worry about weed or it’s use since that’s been discussed here. The worry here is the over reach of the government, again!!

I think the need to clearly identify and document "articulable symptoms" of use - with no clear standard of what constitutes articulable symptoms - will hamper employers' ability to remove workers who report for work in an impaired condition.

The main reason for this is because current testing standards have not yet been developed to determine level of impairment at any given time. My metabolism may be so vastly different from the next guy's that I show 4x the metabolite they do when I smoked 2 weeks ago, and they are a daily user.

I also know very accomplished people in esteemed positions that are users. People talk about a silent majority; well pot users have been a silent majority in this country for decades.

I normally don't support government intrusion but drug testing policies are backwards when it comes to marijuana; especially in states where it's "legal."

Years ago they didnt have breathalizers for alcohol checks, they used observation and the old "touch your nose, walk a straight line" etc. They use the same for determining impairment for drugs.Eventually they will come up with a revenue generating pot test.I dont believe the DWI issue will be a problem as I believe there are a lot more people smoking than you think and the numbers arent going to increase by a whole lot with legalization.They've been driving while stoned for a very long time before all this legalization with few problems.

Legalized state "law" or not.
It is still under federal scrutiny, as evident by the "lawful" NICS background checks for firearms purchasing.
With all the gov surveillance, anyone on the users list will be denied their 2A right.

A 6 pack consumed in 2 hours is no where near close to smoking a pound of weed. Shitty weed from years ago maybe. Again keep in mind there is a huge difference in smoking a joint from the 70’s and smoking a joint of the boutique weed of today. The edibles are highly potent and people react to edibles much stronger and differently than smoking weed. Much research has been done on this and the information is readily available of your choose to seek it out.
I was just talking to a friend who uses edibles this weekend and they make him hallucinate and feel things that aren’t happening to him. That’s just the recommended dose. Many use over that since edibles take a while to kick in. A few beers will not do that.
There is much information out there on these effects. Don’t take my word for it since I use neither alcohol or any drugs.

No tinfoil hat here. That’s why it was added to the 4473 form. I think you’re spot on. I think what will happen and what they are counting on is that younger people will chose weed over guns and this will be a way to diminish the amount of gun owners. When there are few gun owners the attack on the 2a will be much easier and more successful.
