I highly doubt that will go through. It was discussed as directly being unconstitutional in the ruling. In addition if it’s declared unconstitutional to show a need to carry then making everywhere in nys/nyc a sensitive place would be unconstitutional as well.

SCOTUS doesn't generally issue orders to states or governments. They issue orders to appellate courts when they think those courts made mistakes.

They order the appellate courts to fix their mistake. Because the appellate courts are the ones that report to them, not the states.

This is pretty universal and basic chain of command stuff.


If the CEO wants a new color widget, he doesn't go down to the production line and order the painter to start spraying. He orders the COO to pass the order down the line.

Carrying a firearm in NYS is illegal … then it makes an exception for a pistol permit for concealed carry. Then the exception for open carry is for security guards.
It’s similar to what happened to the NJ cop with LEOSA who let his jacket not hide his pistol in Manhattan. They charged him with CPW. It was plead down to a much lesser violation and I think the case was sealed.

In this case SCOTUS *has not* ordered NY to do anything.

There isn't at this point an order for them to ignore.

Read the decision. SCOTUS literally vacated the precious 2nd circuit decision (putting things right back where they were before that decision was made) and then ordered the 2nd circuit to issue a new decision consistent with the new guidance from SCOTUS on the matter.



So, the superintendent hasn't ordered you to do anything.

You just overheard him giving an order to your supervisor. Your supervisor hasn't officially passed that on to you.

Now, you could take it on your own initiative and start the work now (like CA and NJ have) or you can sit around batching that you aren't going to like the order *when it eventually arrives* like NY is, but at this point, you aren't under any orders at all.

What was the excuse for that exception ? The training that was given was for a standard capacity magazine. Are they going to retrain all the officers before they retire to a 10 round magazine? Notice I wrote the word “ excuse”. It was the only way to get that exception.
Now ask yourself, unless you are a security guard, do you want to carry a full sized service sidearm that wasn’t your choice of weapon? Or would you rather carry something of your own choice?
I can tell you that the one gun I have with a above 10 round magazine is a safe Queen.
I knew guys that bought the “ banned “ rifles while active police officers who scrambled to get them out of state before they retired.
With the new semi auto licensing, cops won’t be able to buy those non service weapons and keep them when they retire, so don’t worry about that anymore.
Edit: I forgot to add, that retired officers have to requalify with those guns to keep that exemption.

You can argue your case until the cows come home but SCOTUS has spoken. They can require training and I believe they justify that under the 18th century definition of what a militia was . A group of oridinary guys who brought their own weapons to provide for the common defense. And they did train and did have some regulations both before and after the ratification of the second amendment.
Now, let’s use another constitutional right for comparison. Freedom of assembly. Fire codes still apply. Parade permits.
Freedom of speech — obscenities, slander are limits to that right. Or even speaking at certain places and times- like interrupting a political rally can get you arrested.

Courthouses and polling places were sensitive areas before and after the ratification of the 2nd amendment. Schools and Churches ? I know it was frowned upon in Churches. I don’t know if such thoughts applied to schools.
But I do know the school gun free zones attract these active shooters to those areas

I concur, however none of the retirees I've spoken with have any plans to surrender their AW's or standard capacity magazines and I don't fault them a damn bit.... better get all you can now, because unless the entire Legislature and Governor's Office can be replaced with a Republican/Conservative majority and the knee-jerk Legislation that was again rammed through overturned, we WILL see a lot of Gun Dealers closing their doors.
