Percentages are not, but taking a given piece of plastic past the stage approved by the ATF results in a firearm. The term 80% is merely a convention. Even a dimple showing the location to drill a hole is too much if not approved by the ATF.
They are not, as soon as you mill (or partially mill) the fire control cavity it becomes a firearm.

That is the case law, I believe. Although you do have to have pistol frames put on your pistol license in order to get them home from an FFL. With an 80%receiver no FFL is involved to have that dilemma. If I were to manufacture my own frame for a pistol from an 80% receiver it would be a bear to get it on my license. I had a hard enough time changing the caliber from 38 Super to 45 ACP in Jeff County. I cannot imagine the hoops I would have to jump through to go the 80% route.
