The term "unalienable Rights" is used in the Declaration of Independence, not the Constitution. It refers to, specifically, Life, Liberty and the pursuit of Happiness.

The Bill of Rights does not apply to foreign invaders. Neither the Declaration or the Constitution say that non-citizens are entitled to court appearances, welfare, handouts or anything else the commies want to provide to the hoards of invaders trying to take over the US. In fact, one of the duties of the President is to defend against foreign invasion. You don't defend against invasion by giving free speech, protections against searches, protections against self incrimination... And you don't guarantee the right to bear arms to people trying to invade your country.


"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. Correct. The Declaration however does not call them out specifically. Neither does the original constitution. Thats why the first 10 amendments are so important, it lists the unalienable rights that everyone is endowed by their Creator.

Welfare and handouts are not covered in the BOR. Neither is voting rights for that matter. No one is arguing that illegal aliens are afforded these rights. These are rights created by men and granted to men. They can be taken away or denied by men.

But free speech, religion, torture, due process, bear arms, self incriminating etc.... apply to everyone regardless of citizenship status. Legal citizen, green card holder, Visa holder, illegal alien.... we dont want to go down the slippery slope of allowing government to decide who gets rights and who doesnt.

As far as due process for illegals... deportation is part of the process. Its the first part. Don't need a lengthy court proceeding to deport. Send them packing and they can stay in their home country while they wait for their case to be heard. No different than a suspect being held in jail pending trial. Instead of being here in jail waiting for their day in court, theyre sent packing to their nation of origin. Simple.

dwa12479 is right with a very good argument that inalienable rights are for all men and are instilled by our creator, not created and handed out by and at the whim of our government. Spat is also correct that due process is not only essential, but is also different for citizens and non-citizens. So, we respect inalienable rights and provide due process. The process that is due for illegal aliens is to verify that they have broken the law by illegally entering the USA and the result of that due process is deportation. The process that is due for aliens with valid student green cards who espouse violence and terrorism in our country is to verify that they have broken the law for student green card holders by their actions and the result of that due process is to deport them. Detention, arrest, jailing, charges and arraignment are parts of the due process that result in temporary loss of freedom and separation from family. Some inalienable rights are limited or restricted by citizenship. Not all rights in the bill of rights amended to the constitution are inalienable as some are explicitly for citizens only.
