Another cop that has no clue of the law nor does he know how to interact with the public.
They could have should have handled this much better. Articulate the real reason he was stopped. Explain, exactly, why he was stopped. If there was a real reason for the stop, all would be good.

This is the same as the open carry arrests. Guy legally open carries down the street. Cops stop him. Demand ID. Guy says that open carry is legal and since no crime was committed, no ID is necessary.

Retraining and understanding of the laws is needed. It is one thing, like in this situation, if one officer makes a mistake. Mistakes do happen. But there were seven officers that continued the error.
At least one of them should have known the truth and understand the law. Apparently in Virginia, they do what they want.

There is a whole culture of photographers on YouTube that conduct 1st Amendment Audits. These guys are more proactive than gun owners. It’s a shame.

Well we can add a few new dog whistles the cops can blow to violate our Rights from the two videos:
"You're taking pictures when it's cold out, so we must detain you and get a positive ID because Islam."
"That red light on your camera phone might be a laser sight to assassinate officers of the "law" while we are engaged in a traffic stop."
We can add these to such classics as:
"I smell marijuana."
"You are not allowed in the public tax payer funded library while transmutilated freaks are grooming children."
"You swerved a bit in your lane."
"You are not using the correct pronouns when you address officer Bertha."
"We had a call."
And the perennial favorite:
"Negro, you're giving me lip!"

Now how exactly do you know that the cop in question "has no clue of the law?"
Did you read the law and draw a conclusion for yourself about what it means? I.e., did you interpret the law for yourself?
I thought you don't want beat cops to do that? Or does that pertain only to other cops, not yourself?
Shame comrade. You're going to need some reeducation and special naughty cop training before we can let you enforce what we tell you to enforce.

They arrested him because he had a mask on while they were trying to identify him. That may be legal.
However, they had no reason to demand ID in the first place.
The guy mentioned a mask law--can't wear a mask to conceal identity--but the cop already acknowledged it was cold out and another cop had a mask for the same reason, so I see no conviction there.

I know he did not know the law because he needed to call in a supervisor in order to articulate why he stopped him. He had no clue.

The law in fact allows for numerous reasons people are "allowed" to wear a mask; health reasons are one of them and the perp stated he was cold, the same reason one officer allowed for his special cop buddy who was wearing a mask and filmed doing so.
Further, the "perp" did finally offer his name prior to his arrest, and it appears he may have pulled his mask to keep the cold out down after being harangued by cops causing a public disturbance so they could find something to charge him with under color of law.
He was arrested because he did not and apparently was not able or willing to produce paper ID or give his DOB while detained and "under investigation" (not under arrest).

Very much agree.
He ought to have lowered his mask earlier to show his good intentions of obeying the applicable law ("it's cold officer, I would like to put my mask back on for my own health now"), and he certainly should not have been looking for an attorney after the fact of his arrest, but had one already on at least a small retainer.
He did pretty good though in a ridiculous, cop made-up situation though.

I'm not a lawyer but...seems like total bullshit to me. And he filmed it, and the cops filmed it. Will be interesting to see this thrown. Will not whatsoever change the behavior of these cops.
I still want to see a video like this where the perp does literally nothing but stand there. Does not say a single word.

I also hate how there were six of them. It was obvious very early on he wasn't going to be breaking out a hidden machine gun or bomb vest. Why were they all standing there? One reason only: intimidation.

An arrest while lawfully(!) openly carrying strictly for failure to produce an ID (whatever garbage might be made up to achieve that) is another form of gun registration, as your identity will be verified as far as possible and a record produced for your weapon of choice when the cops inventory your personal property.
And of course, at least in certain states, it might be confiscation as well when states like NY refuse to return your weapon and jerk commendable citizens and their lawyers like RBean around for years in the courts.
All in violation of the 4th and 5th Amendments to our Constitution.

In NY it wouldn't matter ultimately. NY law enforcement has had their wings clipped and are not supposed to inform ICE or Border Patrol, so the illegal walks, at least if they get him to the station house I'd imagine.
The smart illegal in NY grabs his NYS ID, on which Cuomo the homo has declared by the signage of law that immigration status and IIRC even date of birth, SS#, etc. cannot even be collected by DMV or inquired about by law enforcement.
Clearly the illegal alien is more of a citizen than American born tax payers. Free ID with little if anything to verify their credentials, free social welfare net, free college or job training, no need to even bother with proof of vehicle insurance since they don't even have SS# and NY will not allow them to be deported by the Feds.
An American citizen is now not only second class to our very own elite scum, but to non-citizens as well.
