I'm sort of half in agreement with both you and @Willjr75 on this one. I'm not beyond recognizing practicality. Should it have been permitted under 2A regardless? Yeah. From a practical standpoint, is it really worth taking that risk vs figuring out alternative arrangements? Probably not.

Still, the biggest mistake anyone makes, is announcing or showing off what they have. Unless you're legally required to tell people you're carrying, or declare something, just keep your mouth shut. People with big mouths cause themselves more trouble then they'd get into otherwise.

A couple of things that I will say.

First, regardless of how unimportant it is, the guy looks like a tool.

Second, if I am not mistaken, IDK, maybe I am, but from the picture I see, I do not see a firearm. I see a bunch of parts, that possibly when put all together, may or may not make a complete gun.

Third, sure, he was in possession of mags that do not conform to NY State law.

Forth, this was not originally found by the Police. Basic security guards found this pile of gun parts. The Police, when called, cannot just turn their backs and say, all is good. If you think that is possible, you are an idiot.

Your applying a defense thought process for an offensive criminal activity. how often you see criminals looking for knives or frisking people ... they don't, they don't care, its reactionary, interfere and you may get shot, they need an example just for the hell of it you may get shot, you look in their eyes you may get shot... they will choose you for what every reason. As far as I'm concerned if he had no intent to do anything criminal, then he can do what the hell he wants with his property in a room he rented. You have the same rights to privacy and to defend yourself in a hotel room as you do at home ... and no that's not my opinion its case law.

If he gets a good lawyer I would not be surprised if this case gets tossed.

In light of the Las vegas Shooting, it wasn't just dumb , its alarming. Maybe the guy had a legit reason to bring his weapon in his room like a completive shooter having a little fun and food after or before a match .Maybe he thousands into the rifle and didn't want to leave it his car trunk. Maybe the rifle was broken down and he didn't have any loaded mags with him . Ok, maybe the cops can give him a pass. But if had multiple mags loaded and present , the intent looks a lot different. Maybe he threated the casino or an ex girlfriend who worked there or got into an argument, . The context of what he was doing with it really makes a difference. Im all about the 2nd A , but Jesus, this guy may have had bad intentions. I cant find any good reason to go to a casino with an AR.

Go walk out in front of a school open carrying an AR , because you want to protect the kids . and your going to find yourself in a similar situation.

Doesn't make a difference because it is NOT a firearm. The barrel is just a hollowed out metal pipe unless it is a fully functioning gun, which it is not.

They don't have too list it, the definitions of what are parts and what is the actual firearm vs parts is covered under NFA. The serialized lower receiver is the firearm ... not the upper. NY laws states a semiautomatic capable of accepting detachable magazine .... and 1 feature ... the pistol grip and collapsible stock sans upper satisfies the law. under the law. If it was a fixed stock and grip not attached he may have had an argument.

According to the unSafe law, in order for a rifle to be an assault weapon, its got to be a semi automatic rifle with certain cosmetic features. A lower receiver, assembled or not, does not meet the criteria of assault weapon as defined. Similarly, an upper receiver is not an assault weapon. The law makes no mention of parts that if assembled could make an assault weapon. The rifle has to be assembled and have the specific cosmetic features to meet the definition of assault weapon.
