I’m not sure how intent got into this. A CPW charge for possession of an assault weapon requires no showing of any intent or other mental state.

Its also a term used by lawyers when all evidence following a Constitutional violation is inadmissible, no matter how factual and pertinent it may be. The SAFE act was enacted in violation of the NY constitution, ergo fruit of the poisons tree, not that that or the federal one mean anything anymore, at least in this gulag.

Fruit of the Poisonous Tree is a term coined by Justice Felix Frankfurter in the Nardone case - it only applies to 4th amendment violations.
